NOTICE OF MORTGAGEE’S SALE OF REAL ESTATE
Premises: 3 Didio Drive, Swampscott, MA 01907
By virtue and in execution of the Power of Sale contained in a certain mortgage given by William Trahant, Jr. to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Mortgage Network, Inc., and now held by Selene Finance, LP, said mortgage dated February 11, 2022 and filed in the Essex County (Southern District) Registry District of the Land Court as Document No.: 633819 and noted on Certificate of Title No.: 96277,said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Mortgage Network, Inc. its successors and assigns to Selene Finance LP by assignment dated February 24, 2025 and filed with Essex County (Southern District) Registry District of the Land Court as Document No.: 657087 and noted on Certificate of Title No.: 96277; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on April 20, 2026 at 01:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
A certain parcel of land situated in Swampscott in the County of Essex and said Commonwealth of Massachusetts, together with the buildings and improvements thereon, bounded and described as follows:
SOUTHEASTERLY by Didio Drive one hundred (100) feet;
SOUTHWESTERLY by lot 26, as shown on plan hereinafter mentioned, one hundred thirty- eight and 56/100 (138.56) feet;
NORTHWESTERLY by land now or formerly of Charles P. Coffin one hundred twenty- three and 87/100 (123.87) feet; and
NORTHEASTERLY by lot 28, as shown on said plan, one hundred forty-two and 23/100 (142.23) feet.
All of said boundaries are determined by the Court to be located as shown upon plan numbered 29591-B drawn by Carter & Towers Engineering Corp., Surveyors, dated February 9, 1965, as modified and approved by the Court filed in the Land Registration Office, a copy of a portion of which is filed with Certificate of Title #36752 in the Southern Registry District of Essex County, and the above described land is shown as lot #27, on last mentioned plan.
The above described land is subject to easements as set forth in two grants, one made by Hilaire H. LeBel, et al to the Lynn Gas and Electric Company, now known as Lynn Electric Company, and New England Telephone and Telegraph Company, dated March 15, 1956, duly recorded in Book 4259, Page 593 and the other made by John Didio et ux to said Lynn Gas and Electric Company, now known as Lynn Gas Company, dated December 18, 1959, duly recorded in Book 4632, Page 404 in said Registry.
The above described land is subject to the covenant between the Planning Board of the Town of Swampscott and John Didio, dated April 12, 1961, duly recorded in Book 4766, Page 229, as affected by an instrument dated May 23, 1961, duly recorded on August 3, 1961, in Book 4800, Page 54 in said Registry.
And it is further certified that said land is under the operation and provisions of Chapter 185 of the General Laws, and that the title of said land is under said chapter, subject, however, to any of the encumbrances as aforesaid; and to the memoranda of encumbrances for this certificate.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated January 27, 2022 and registered with the Essex County (Southern District) Registry District of the Land Court as Document No.: 633818 and noted on Certificate of Title No.: 95415.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
