NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Rosemarie G. Currier to Mortgage Electronic Registration Systems, Inc., as nominee for H&R Block Mortgage Corporation, dated November 20, 2006 and recorded in the Middlesex County (Southern District) Registry of Deeds in Book 48776, Page 131, of which mortgage the undersigned is the present holder, by assignment from:
Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for H&R Block Mortgage Corporation, its successors and assigns to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for Legacy Mortgage Asset Trust 2021- SL1, recorded on December 8, 2023, in Book No. 82294, at Page 186 U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for Legacy Mortgage Asset Trust 2021- SL1 to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Trustee of Arugula Funding Titling Trust, recorded on December 16, 2025, in Book No. 85013, at Page 339 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 12:00 PM on April 15, 2026, on the mortgaged premises located at 39 Grant Avenue, Unit 39, The 39-41 Grant Avenue Condominium, Belmont, Middlesex County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
ALL THAT CERTAIN LAND SITUATED IN THE STATE OF MA, COUNTY OF MIDDLESEX, CITY OF BELMONT, DESCRIBED AS FOLLOWS:
THE DWELLING UNIT (HEREINAFTER REFERRED TO AS 'THE UNIT") KNOWN AS AND DESIGNATED AS UNIT NUMBER 39, 39 GRANT AVENUE, THE 39-41 GRANT AVENUE CONDOMINIUM, A CONDOMINIUM SITUATED IN THE TOWN OF BELMONT, MIDDLESEX COUNTY, MASSACHUSETTS (THE POST OFFICE ADDRESS OF WHICH IS 39 GRANT AVENUE, UNIT NUMBER 39, BELMONT, MIDDLESEX COUNTY, MASSACHUSETTS 02472), SAID CONDOMINIUM HAVING BEEN CREATED BY THE SAID TIMOTHY R. HOLMES AND JEAN MARIE HOLMES, PURSUANT TO A MASTER DEED DATED FEBRUARY 23, 2004 AND RECORDED WITH THE MIDDLESEX SOUTH REGISTRY OF DEEDS IN BOOK 42129, PAGE 371, AS THE SAME MAY BE AMENDED OF RECORD, IN ACCORDANCE WITH AND SUBJECT TO THE PROVISIONS OF CHAPTER 183A OF THE GENERAL LAWS OF THE COMMONWEAL TH OF MASSACHUSETTS. SAID UNIT IS CONVEYED WITH THE EXCLUSIVE USE AREA TO THE DRIVEWAY AND EXCLUSIVE USE TO THE BASEMENT, ALL AS REFLECTED ON THE PLANS FILED WITH SAID MASTER DEED, ALONG WITH 40.0 PERCENT OF THE UNDIVIDED INTEREST IN THE COMMON AREAS AND FACILITIES (HEREINAFTER REFERRED TO AS "THE COMMON ELEMENTS") AS PROVIDED IN SAID MASTER DEED. OF 11 TOURO AVENUE MEDFORD, MASSACHUSETTS 02155, DULY RECORDED WITH SAID MASTER DEED, A COPY OF A PORTION OF WHICH (BEARING THE VERIFIED STATEMENT OF A REGISTERED ARCHITECT REQUIRED BY SECTION 9 OF CHAPTER 183A OF THE GENERAL LAWS OF THE COMMONWEALTH OF MASSACHUSETTS) IS ATTACHED HERETO, TO WHICH THE MASTER DEED AND PLANS REFERENCE IS HEREBY MADE FOR A FURTHER AND MORE PARTICULAR DESCRIPTION OF THE UNIT AND THE RIGHTS AND INTERESTS APPURTENANT THERETO. THE 39-41 GRANT AVENUE CONDOMINIUM IS COMPRISED OF LAND WITH THE BUILDINGS THEREON, IMPROVEMENTS AND STRUCTURES THEREON SHOWN ON THE SITE PLAN RECORDED WITH SAID MASTER DEED AS PLAN NUMBER 180 OF 2004 AND ON THE PLANS MENTIONED ABOVE, THE LAND AREA BEING THE SAME DESCRIBED IN EXHIBIT "A" OF THE MASTER DEED, TO WHICH THE PLAN AND MASTER DEED REFERENCE IS HEREBY MADE FOR A FURTHER AND MORE PARTICULAR DESCRIPTION OF SAID LAND AREA.
Subject to a first mortgage dated November 20, 2006 and recorded in the Middlesex County (Southern District) Registry of Deeds at Book 48759, Page 173 in the original principal amount of $284,000.00.
For mortgagor's(s') title see deed recorded with Middlesex County (Southern District) Registry of Deeds in Book 43116, Page 374.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
