NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 08/24/2006, LISA BRADDY, A SINGLE WOMAN executed a promissory note payable to the order of FIRST MISSISSIPPI CAPITAL CORPORATION, AS LENDER
WHEREAS, the aforesaid promissory note was secured by a Deed of Trust dated 08/24/2006, executed by LISA BRADDY, A SINGLE WOMAN and being recorded on 08/29/2006 in Book 2092, Page 0281 as Document No. 511266 of the records of the Madison County, State of Mississippi; and which aforesaid Instrument conveys to THOMAS F. VETTERS, Trustee and to FIRST MISSISSIPPI CAPITAL CORPORATION, AS LENDER, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS BENEFICIARY, as Beneficiary, the hereinafter described property; and
WHEREAS, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR FIRST MISSISSIPPI CAPITAL CORPORATION, assigned said Deed of Trust to HSBC Bank USA, N.A., as Trustee on behalf of ACE Securities Corp. Home Equity Loan Trust and for the registered holders of ACE Securities Corp. Home Equity Loan Trust, Series 2007-HE4, Asset Backed Pass-Through Certificates via an instrument filed of record on March 14, 2008 as Document No. 559105, in Book 2295, and at Page 0528 in the office of the Clerk of the Madison County, State of Mississippi; and
WHEREAS, HSBC BANK USA, N.A., AS TRUSTEE ON BEHALF OF ACE SECURITIES CORP. HOME EQUITY LOAN TRUST AND FOR THE REGISTERED HOLDERS OF ACE SECURITIES CORP. HOME EQUITY LOAN TRUST, SERIES 2007-HE4, ASSET BACKED PASS-THROUGH CERTIFICATES appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC, as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 10/31/2024 and recorded on 11/13/2024 in Book T-4497, Page 350 as Document No. 1014176 of the records of the Madison County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said promissory note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc, the Substituted Trustee in said Deed of Trust will on 04/09/2026, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the South Door of the Madison County Courthouse, 128 West North Street, Canton, MS 39046, the following described property located and situated in Madison County, Mississippi, to wit:
LOT 185, VILLAGE SQUARE SUBDIVISION, PART I, a subdivision according to a map or plat thereof which is on file and of record in the office of the Chancery Clerk of Madison County at Canton, Mississippi, in Plat Cabinet B, at Slide 38, reference to which is hereby made in aid of and as a part of this description.
LESS AND EXCEPT THAT CERTAIN PROPERTY CONVEYED BY WARRANTY DEED RECORDED IN BOOK 364, PAGE 559 BEING DESCRIBED AS FOLLOWS:
Part of Lot 185, VILLAGE SQUARE, Part I, and further described as follows, to-wit:
Being the western part of Lot 185, VILLAGE SQUARE, Part I, according to a plat on file in the office of the Chancery at Canton, Madison County, Mississippi in Plat Cabinet B at Slide 38, and being more particularly described by metes and bounds, to-wit:
Beginning at the Southwest corner of said Lot 185 and run North 16 degrees 10 minutes East along the West line of said Lot 185 a distance of 142.02 feet to the Northwest corner of said Lot 185; thence Easterly along the arc of a curve bearing to the right having a radius of 241.53 feet and a delta angle of 21 degrees 15 minutes marking the North line of said Lot 185 for a chord distance and bearing of South 67 degrees 02 minutes 43 seconds East, 24.57 feet to the Point of Tangency of said curve; thence South 67 degrees 03 minutes East and continue along the North line of Lot 185 a distance of 4.1 feet; thence South 15 degrees 46 minutes West along a party wall and projection thereof a distance of 140.43 feet to a point in the South line of Lot 185; thence North 76 degrees 12 minutes West along the South line of said Lot 185 a distance of 29.41 feet to the Point of Beginning, containing 0.094 acres, more or less.
This conveyance is more particularly described as the Eastern portion of Lot 185, Village Square, Part I.
