88 Spruce St, Winchendon, MA 01475
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Lisa A. Wieland to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Central Mortgage Funding, LLC, its successors and assigns, dated December 20, 2022 and recorded in Worcester County Registry of Deeds in Book 68661 , Page 261 , of which mortgage the undersigned is the present holder by assignment from: Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Central Mortgage Funding, LLC, its successors and assigns to Lakeview Loan Servicing, LLC recorded May 14, 2025 in Book 71980 at page 374, the mortgage was assigned to Lakeview Loan Servicing, LLC, for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction on April 17, 2026 at 1:00PM local time upon the premises 88 Spruce St, Winchendon, MA 01475, all and singular the premises described in said Mortgage, to wit:
A certain tract of land, with the buildings thereon, situated the northerly side of Spruce Street, in Winchendon, Massachusetts, being shown as Lot "B" on a certain plan titled "Plan of Lots surveyed for R.Z.R, Inc." dated April 12, 2005 recorded at the Worcester Registry of Deeds at Plan Book 827, Plan 101
and to which plan reference may be made for a more particular description of Lot 'B"
Said Lot "B" contains 30,057 square feet according to said plan.
Said premises are conveyed subject to and together with the benefit of restrictions, easements, covenants, agreements and notations set forth or referenced on the aforesaid plan, and of record. if any there be, insofar as the same are now in force and applicable.
Together with and subject to the driveway access easement set out in the Easement dated June 23, 2005 recorded herewith in Book 36628, Page 390.
Being a portion of the premises conveyed R.Z.R., Inc., by deed dated December 18, 1985 recorded at Worcester Registry of Deeds at Book 9131, Page 240.
For title see deed of R.Z.R., Inc. to John H. Bryant dated June 23, 2005, recorded herewith in Book 36629 Page 41.
The premises are to be sold and conveyed "as is" subject to and with the benefit of all rights, rights of way, easements, restrictions, covenants, encroachments, building and zoning laws, liens, improvements, unpaid taxes, tax titles, water and sewer liens, municipal liens and assessments, and any other encumbrances of record which are in force and applicable having priority over said mortgage whether or not reference to such restrictions, easements, improvements, liens, encumbrances is made in the deed and will be subject to any rights of redemption for unpaid federal taxes, if any, as shall, notwithstanding this provision, constitute valid liens or encumbrances thereon after said sale, rights of tenants and parties in possession, and attorney's fees and costs if any, which take precedence over the said mortgage above described.
TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer's check or money order at the time and place of sale will be required to be Paid by the purchaser in the form of certified funds at the time and place of sale. The Deposit shall be forfeited to the mortgagee if the successful bidder does not comply strictly with the terms of the Memorandum of sale. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified funds to Albertelli Law, 5404 Cypress Center Dr., Ste 300, Tampa, FL 33609. A deed will be provided to the purchaser for recording upon receipt of the full purchase price. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. The description of the premises contained in said mortgage shall control in the event of an error in this publication. By order of the present holder of said Mortgage which hereby gives notice of its intention to bid as said sale or at any adjournment or postponement thereof.
