MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Polar Views LLC to Steven A. Ross, Trustee of QS Lending Two Trust, dated December 5, 2024 and recorded on December 6, 2024 with the Worcester County Registry of Deeds in Book 71384, Page 98 of which mortgage the undersigned is the present holder, and in which the mortgaged premises consist of a two certain parcels of land with the buildings and improvements thereon located in Millbury known as 32 Singletary Road, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1:00PM on the 22nd day of April 2026, at the mortgaged premises located at 32 Singletary Road, Millbury, Massachusetts, all and singular the premises described in said mortgage.
To wit:
The Land referred to herein below is situated in the County of Worcester, Commonwealth of Massachusetts and is described as follows:
PARCEL 1
The land in Millbury on the westerly side of West Sutton Road now known as Singletary Road, bounded and described as follows:
Beginning at a point in the westerly line of said Road at the northeasterly corner of the within described premises at land now or formerly of one Wingberg;
Thence S. 15 1/2° W. 91.3 feet by the westerly line of said Road to a stake;
Thence S. 2 1/4° W., still by the westerly line of said Road, 45.65 feet, more or less, to a point;
Thence N. 70° W. 218.45 feet, more or less, to a point at land now or formerly of said Wingberg;
Thence N. 14° E. by said Wingberg land, 136.95 feet to a point;
Thence S. 69° E. still by said Wingberg land, 212.7 feet to the place of beginning.
Also including a right of way from said road to Singletary Pond over a strip of land 12 feet wide which is bounded on the northerly side by land, now or formerly of one Ballard, and on the southerly side by a line parallel with and 12 feet distant from, said Ballard land. This right of way is over the northerly end of the third tract described in a deed from Doris A. Johnson to Axel A. Wingberg et ux recorded in Worcester District Registry of Deeds, Book 2538, Page 343.
Also conveying all our right, title, and interest in the land which lies between the above- described tract and the center line of said road.
PARCEL 2
The land in Millbury situated on the westerly side of West Sutton Road, now known as Singletary Road, bounded and described as follows:
BEGINNING at a point in the westerly line of said Singletary Road and being the northeasterly corner of the premises herein described and the southeasterly corner of land now or formerly of Axel W. Linder et ux;
THENCE N. 69° 30' W. by said Linder land 210 feet, more or less, to a point, being the southwest corner of said Linder’s land;
THENCE southwesterly about 22 feet to the northwest corner of land now or formerly of Stephen S. Bek et ux;
THENCE S. 69° E. by said Bek land 212.7 feet to a point in the westerly line of said Singletary Road, said point being the northeast corner of said Bek land;
THENCE Northeasterly by the westerly side of said road to the point of beginning. CONTAINING 2220 square feet, more or less.
Also including an easement in a right of way from said road to Singletary Pond over a strip of land 12 feet wide which is bounded on the northerly side by land, now or formerly of one Ballard, and on the southerly side by a line parallel with and 12 feet distant from said Ballard land. This right of way is over the northerly end of the third tract described in a deed from Doris A. Johnson to Axel A. Winberg et ux, recorded in Worcester District Registry of Deeds in Book 2538, Page 343.
Also conveying all right, title, and interest in the land which lies between the above-described tract and the center line of said road.
For title see deed recorded with said Worcester District Registry of Deeds in Book 68792, Page 226.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid condominium fees, taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. No representations express or implied are made with respect to any matter concerning the premises, which will be sold “as-is”.
TERMS OF SALE:
Twenty-Five Thousand and 00/100 Dollars ($25,000.00) shall be paid in certified or bank cashier's check by the purchaser at the time and place of said sale, and the balance of the purchase price shall be paid by certified or bank cashier's check at the offices of Erik T. Potter, Esq., Potter MacLellan LLP, 113 Ripley Road, Cohasset, MA 02025 within thirty (30) days from the date of sale. The successful bidder of the sale of the premises shall be required to sign a Memorandum of Terms of Sale containing the above terms at the Auction Sale. The Mortgagee reserves the right to bid at sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
