NOTICE OF PUBLIC
HEARING
TOWN OF UNION
PLEASE TAKE NOTICE that the Town Board of the Town of Union, Broome County, New York has approved a resolution calling for a public hearing to solicit public input for the proposed dissolution of the Choconut Water District.
The public hearing will be held at Town Hall, 3111 East Main Street, Endwell, New York on Wednesday, May 20, 2026, at 7:00 P.M., at which time all persons interested in the subject matter thereof will be heard. The purpose of the public hearing shall be to receive public input for the proposed dissolution of the Choconut Water District.
Please take further notice that any information concerning the proposed dissolution of the Choconut Water District which is the subject matter of the public hearing is posted on the Town’s website, posted at the Town Hall and available for inspection at the Town Hall in the Town Clerk’s office Monday through Friday 8:00 A.M. through 4:00 P.M.
A descriptive summary of the proposed Dissolution Plan is as follows:
The Town of Union, a municipality in the State of New York (the “Town”) proposes to dissolve the Choconut Water District (the “District”).
The territorial boundaries of the District include portions of the following roads: East Maine Road, Lower Stella Ireland Road, Middle Stella Ireland Road, Airport Road, Rhodes Road, Daisy Drive, Dimmock Hill Road, Cherese Lane and Lewis Road. Residents of the District will continue to receive water service following the dissolution in accordance with an Acquisition Agreement with the Village of Johnson City (the “Village”) which provides for a transition of the District to the Village.
The District’s assets consist of primarily the water distribution lines, meters, appurtenances thereof, and equipment used in the maintenance and repair of the same
The Village owns and operates a municipal water system and has determined that it is in the public interest to acquire the District’s water infrastructure and assume ownership and operation of the District.
Upon the dissolution of the District, the Village shall undertake responsibility for water distribution, billing, operation, and maintenance of the District’s water system, while ensuring continued service to existing District customers and recipients at levels consistent with applicable regulatory requirements. Residents of the District will continue to receive water service following the dissolution with future billings directly from the Village.
The District’s existing liabilities and indebtedness, bonded and otherwise, in the approximate amount of $52,000 will continue to be a taxable property item in the acquisition of the District by the Village in future billings until said debts and liabilities are fully retired.
Upon approval of the Dissolution Plan following the public hearing which is scheduled for May 20, 2026, the Dissolution Plan calls for the dissolution enactment of the Town’s Resolution calling for a Referendum on the proposed dissolution by Electors of the Choconut Water District. The Resolution calling for the Mandatory Referendum is in accordance with General Municipal Law Article 17-A Title Three and New York Town Law Section 198. The Mandatory Referendum shall be in accordance with Section 198 of New York Town Law setting forth the substance of the question to be submitted to the Electors and setting forth other matters necessary to call, provide for and give notice of the Referendum and to provide for the conduct thereof and the canvas of the returns thereon. The Resolution calling for the Referendum and the proposed dissolution shall be attached to it as the final approved version of the Dissolution Plan which Referendum shall be held not less than thirty (30) days and no more than ninety (90) days following adoption of the Resolution for Dissolution.
No later than five (5) days after the commencement of dissolution proceedings pursuant to Article 17-A, Title 2, the Town Clerk shall cause a copy of the proposed Dissolution Plan, along with a descriptive summary thereof, to be displayed and readily accessible to the public for inspection in public places within the Town of Union, cause the proposed Dissolution Plan, along with a descriptive summary thereof and reference to the public place or places withing the Town where a copy may be examined, to be displayed on the website maintained by the Town; and arrange to be published in the Press & Sun-Bulletin a descriptive summary of the proposed Dissolution Plan which may be examined along with the Dissolution Plan at the office of the Town Clerk, Town of Union, 3111 East Main Street, Endwell, New York 13760, at least once each week for four consecutive weeks.
