MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Andrew T. Tripp and Tiffany A. Crowley to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for First Horizon Home Loan Corporation, its successors and assigns, dated October 11, 2006 and registered at Barnstable County Registry District of the Land Court as Document No. 1046837 and noted on Certificate of Title No. C73-10A (the “Mortgage”), as affected by a Loan Modification Agreement dated March 16, 2015, and registered as Document No. 1271061 and noted on Certificate of Title No. C73-10A of which mortgage U.S. Bank Trust National Association, not in its individual capacity, but solely as trustee of Citigroup Mortgage Loan Trust 2020-RP1 is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., solely as nominee for First Horizon Home Loan Corporation, its successors and assigns to Federal National Mortgage Association dated February 21, 2012 and registered as Document No. 1185657 and noted on Certificate of Title No. C73-10A, and Assignment from Federal National Mortgage Association to U.S. Bank Trust National Association, not in its individual capacity, but solely as trustee of Citigroup Mortgage Loan Trust 2020-RP1 dated December 15, 2020 and registered as Document No. 1416386 and noted on Certificate of Title No. C73-10A, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 42 Heritage Drive, Unit 10A, of the Tradewinds "10" Condominium, Buzzards Bay (Bourne), MA 02532 will be sold at a Public Auction at 11:00 AM on May 20, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
Unit 10A in Tradewinds "10" Condominium created by Master Deed dated May 8, 1980 and registered May 21, 1980 with the Barnstable County Registry of Deeds, Land Court Section, as Document No. 266,154 on Certificate No. 80711, in accordance with the provisions of G.L.c. 183A grants the Unit to Grantee.
The Unit contains the area listed above and is laid out as shown on a plan 14725-5-1 registered with Document No. 222,154 which copy of a portion of the plans filed with the Master Deed and to which is affixed a verified statement in the form provided for in G.L.c. 183A, section 9.
The unit is conveyed together with a 50% interest (a) in the common areas and facilities of the condominium, as described in the Master Deed and (b) in the Tradewinds 10 Condominium Trust, both registered with said Barnstable Registry of Deeds, Land Court Section, Document No. 266, 154 and Document No. 266,155 respectively on May 21, 1980.
The Unit is to be used only for residential purposes and nor for other purposes, except as may be expressly permitted by the trustees in accordance with the provisions of the Tradewinds "10" Condominium Trust.
The Grantee acquires the Unit with the benefit of, and subject to, the provisions of G.L.c. 183A, relating to condominiums as the statute is written as of the date hereof, the Master Deed and Condominium Trust referred to above and any By-Laws and rules and regulations from time to time adopted there under, and all matters of record stated or referred to in the Deed as completely as if each were fully set forth herein and subject to real estate taxes attributable to the Unit which are not yet due and payable.
For mortgagor’s title see deed registered at Barnstable County Registry District of the Land Court as Document Number 965786 and Noted on Certificate of Title Number C73-10A.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
