Pursuant to the power of sale contained in the Security Deed executed by JESTIN WAYNE GILBERT to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS GRANTEE, AS NOMINEE FOR MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS GRANTEE, AS NOMINEE FOR AMERIS BANK in the original principal amount of $258,146.00 dated May 22, 2024, and recorded in Deed Book 15167, Page 277, Columbia County records, said Security Deed being last transferred to PLANET HOME LENDING, LLC. in Deed Book 15927, Page 142, Columbia County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on 6/2/2026, the property in said Security Deed and described as follows:
ALL THAT LOT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, SITUATE LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF COLUMBIA, BEING KNOWN AND DESIGNATED AS LOT 36-A, BLOCK 36, BRIGHTON WOODS TOWNHOMES ON A PLAT THEREOF PREPARED BY H & C SURVEYING, INC., DATED AUGUST 6, 2018 AND RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF COLUMBIA COUNTY, GEORGIA, IN PLAT BOOK E2018, PAGES 323-326; REFERENCE IS HEREBY MADE TO SAID PLAT FOR A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO THE METES, BOUNDS AND LOCATION OF SAID PROPERTY.
THIS PROPERTY IS CONVEYED SUBJECT TO APPLICABLE EASEMENTS AND/OR RESTRICTIONS SHOWN ON SAID PLAT AND FILED OF RECORD AND TO MASTER DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND EASEMENTS FOR BRIGHTON RECORDED IN DEED BOOK 1116, PAGES 50-107 AND AS AMENDED IN DEED BOOK 11951, PAGES 31-37 AND TO DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR BRIGHTON WOODS TOWNHOMES RECORDED IN DEED BOOK 11681, PAGES 190-264 AND TO ANY AND ALL EASEMENTS, COVENANTS AND RESTRICTIONS SHOWN ON SAID PLAT AND FILED OF RECORD.
SAID PROPERTY IS CONVEYED SUBJECT TO AND WITH NOTICE OF THE FOLLOWING MATTERS: A) DRAINAGE EASEMENTS, BUILDING SETBACK LINES, AND ALL OTHER MATTERS SHOWN ON THE PLAT OF RECORD; H) GENERAL UTILITY EASEMENTS AND ROAD RIGHT-OF-WAY GRANTS AND EASEMENTS.

To the best of the undersigned’s knowledge, the party or parties in possession of said property is/are JESTIN WAYNE GILBERT or tenant(s).
The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Said sale will be conducted subject to the following: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
