NOTICE OF SUBSTITUTE TRUSTEE’S SALE

COUNTY OF FORREST
WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated July 17, 2002, executed by DAVID KNIGHT conveying certain real property therein described to STEPHEN K. THOMAS, as Trustee, for MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INC. AS BENEFICIARY, AS NOMINEE FOR SOUTHSTAR FUNDING, LLC, Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the Office of the Chancery Clerk of Forrest County, Mississippi filed and recorded July 19, 2002, in Deed Book 1227, Page 280; and
WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to U.S. Bank Trust National Association, as Trustee of BKPL-EG Basket Trust; and
WHEREAS, Rubin Lublin, LLC has been appointed as Substitute Trustee; and
NOW, THEREFORE, the holder of said Deed of Trust, having requested the undersigned so to do, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee shall, on June 9, 2026 within the lawful hours of sale between 11:00AM and 4:00PM at the northeast main entrance (back door) of the Paul B. Johnson, Jr., Chancery Building, located at 641 Main Street proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Forrest County, Mississippi, to wit:
LOT 3, BLOCK 18, YELLOW PINE PARK SURVEY OR ADDITION TO THE CITY OF HATTIESBURG, MISSISSIPPI, AS PER MAP OR PLAT ON FILE AND OF RECORD IN THE OFFICE OF THE CHANCERY CLERK OF FORREST COUNTY AT HATTIESBURG, MISSISSIPPI; AND ALSO A PORTION OF LOT 4, BLOCK 18, YELLOW PINE PARK SURVEY OR ADDITION, MORE PARTICULARLY DESCRIBED AS COMMENCING AT THE SOUTHEAST CORNER OF LOT 4; THENCE RUN NORTH ALONG THE EAST LINE OF LOT 4 AND PARALLEL TO MEMPHIS (JACKSON) STREET 4.6 FEET; THENCE RUN IN A WESTERLY DIRECTION TO THE WESTERN BOUNDARY OF LOT 4 TO A POINT WHICH IS 3.3 FEET NORTH OF THE SOUTHWEST CORNER OF SAID LOT 4; THENCE RUN SOUTH 3.3 FEET TO THE SOUTHWEST CORNER OF LOT 4; THENCE RUN EAST ALONG THE SOUTH LINE OF SAID LOT 4 100 FEET TO THE POINT OF BEGINNING; BEING A PART OF LOT 4, BLOCK 18, YELLOW PINE PARK SURVEY OR ADDITION, FORREST COUNTY, MISSISSIPPI; TOGETHER WITH ALL IMPROVEMENTS THEREON AND APPURTENANCES THEREUNTO BELONGING.
PROPERTY ADDRESS: The street address of the property is believed to be 710 MEMPHIS ST, HATTIESBURG, MS 39401. In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control.
Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed, and (3) purchaser’s tendering to Rubin Lublin, LLC, anti-money laundering information as required pursuant to the FinCEN Real Estate Report Rule. Failure to provide information, could result in rescission of the sale.
