Application for Shellfish Aquaculture Leases – Derrick A. Gambrill & Leah B. Gambrill #603, #604, #606 & #607, Wicomico County
The Secretary of Maryland Department of Natural Resources (DNR), pursuant to Natural Resources Article, §4-11A-09(g), Annotated Code of Maryland, is giving notice of applications for four shellfish aquaculture submerged land leases by Derrick A. Gambrill and Leah B. Gambrill in the Wicomico River, Wicomico County, Maryland. The first proposed area (#603), is located approximately 50 feet from the Ellis Bay Wildlife Management Area shoreline northwest of navigation marker “18”, and directly abuts the northeast edge of existing lease, WI 718. This proposed lease area contains 3.2 acres, more or less, and is enclosed by a line beginning at corner 1, at or near Lat. 38° 15' 20" N., Long. 75° 50' 38.4" W., then running 330° 42' (True), approximately 182 meters to corner 2, at or near Lat. 38° 15' 25.1" N., Long. 75° 50' 42.2" W., then running 72° 39' (True), approximately 99 meters to corner 3, at or near Lat. 38° 15' 26.1" N., Long. 75° 50' 38.3" W., then running 167° 30' (True), approximately 175 meters to corner 4, at or near Lat. 38° 15' 20.6" N., Long. 75° 50'36.6" W., then running 247° 5' (True), approximately 47 meters to the point of beginning.
The second proposed area (#604), is located approximately 80 feet from shore parallel to the Holland Point shoreline and approximately 450 feet southwest of navigation marker “17”. This proposed lease area contains 14.5 acres more or less and is enclosed by a line beginning at corner 1, at or near Lat. 38° 14' 46" N., Long. 75° 51' 4.1" W., then running 339°27' (True), approximately 120 meters to corner 2, at or near Lat. 38° 14' 49.7" N., Long. 75° 51' 5.8" W., then running 27° 12' (True), approximately 603 meters to corner 3, at or near Lat. 38° 15' 7.1" N., Long. 75° 50' 54.5" W., then running 108° 35' (True), approximately 91 meters to corner 4, at or near Lat. 38° 15' 6.2" N., Long. 75° 50' 50.9" W., then running 207° 19' (True), approximately 699 meters to the point of beginning.
The third proposed area (#606), is located approximately 1,800 feet due east of Mollies Point and directly abuts the southern corner of existing lease, WI 721. This proposed area contains 31.5 acres more or less and is enclosed by a line beginning at corner 1, at or near Lat. 38° 13' 38" N., Long. 75° 52' 40.5" W., then running 0° 39' (True), approximately 471 meters to corner 2, at or near Lat. 38° 13' 53.3" N., Long. 75° 52' 40.6" W., then running 134° 56' (True), approximately 109 meters to corner 3, at or near Lat. 38° 13' 50.8" N., Long. 75° 52' 37.4" W., then running 50° 26' (True), approximately 124 meters to corner 4, at or near Lat. 38° 13' 53.4" N., Long. 75° 52' 33.4" W., then running 155° 6' (True), approximately 520 meters to corner 5, at or near Lat. 38° 13' 38.1" N., Long. 75° 52' 24.4" W., then running 269° 28' (True), approximately 391 meters to the point of beginning.
The fourth proposed area (#607), is located southwest of Bay Point, partially within Ellis Bay, and adjacent to existing leases WI 717, WI 707, WI 721, and WI 697. This proposed area contains 76.4 acres more or less and is enclosed by a line beginning at corner 1, at or near Lat. 38° 14' 10.5" N., Long. 75° 52' 29.6" W., then running 334° 8' (True), approximately 374 meters to corner 2, at or near Lat. 38° 14' 21.4" N., Long. 75° 52' 36.3" W., then running 332° 46' (True), approximately 239 meters to corner 3, at or near Lat. 38° 14' 28.3" N., Long. 75° 52' 40.8" W., then running 338° 49' (True), approximately 289 meters to corner 4, at or near Lat. 38° 14' 37" N., Long. 75° 52' 45.3" W., then running 94° 32' (True), approximately 808 meters to corner 5, at or near Lat. 38° 14' 35.4" N., Long. 75° 52' 12.1" W., then running 180° 0' (True), approximately 166 meters to corner 6, at or near Lat. 38° 14' 30" N., Long. 75° 52' 12.1" W., then running 241° 43' (True), approximately 465 meters to corner 7, at or near Lat. 38° 14' 22.6" N., Long. 75° 52' 28.8" W., then running 164° 3' (True), approximately 356 meters to corner 8, at or near Lat. 38° 14' 11.5" N., Long. 75° 52' 24.8" W., then running 255° 56' (True), approximately 120 meters to the point of beginning.
The applicants propose to deposit oyster shell and spat-on-shell as needed within each of the given areas to a maximum depth of two inches for the purpose of culturing Eastern oyster (Crassostrea virginica), and to harvest using methods approved by the Department. Lease corners will be marked in accordance with Code of Maryland Regulations. The Department will hold a public informational meeting upon written request from any person whose request also contains their name, mailing address and email address and is received by June 25, 2026. In addition, any person who has a specific right, duty, privilege, or interest that is different from that held by the general public and may be adversely affected by one or more of the proposed leases may file a Petition of Protest with the Department protesting the issuance of the lease(s) by June 25, 2026 or within seven days after a public informational meeting held by the Department. A protest filed with the Department must contain all of the following to be considered valid: 1) the name, mailing address and email address of the protestant; 2) a statement indicating that the protestant intends to protest the lease(s) and the reasons for the protest; and 3) a statement describing the protestant’s specific right, duty, privilege, or interest that is different from that held by the general public and may be adversely affected by the proposed lease(s). Petitions that meet the requirements of Natural Resources Article §4-11A-09(g) shall be forwarded to the Office of Administrative Hearings for adjudication. Comments, requests for a public informational meeting, and/or Petitions of Protest must be received in writing by the Department of Natural Resources Aquaculture and Industry Enhancement Division by email to aquaculturepubliccomment.dnr@maryland.gov or by mail to 580 Taylor Avenue E-4, Annapolis, MD 21401 by the established deadlines.
