NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that upon the Application of NJ Exit 5 Industrial Berry Owner, LLC (the "Applicant"), the Hainesport Township Joint Land Use Board, acting in its capacity as a Zoning Board of Adjustment (the "Board") shall conduct a public hearing on Thursday, June 4, 2026, commencing at 6:30PM in the Hainesport Township Municipal Building, located at One Hainesport Centre, 1401 Marne Highway, Hainesport, New Jersey 08036, to consider a request for Use Variance Approval, Preliminary Site Plan Approval, Final Site Plan Approval, and Bulk Variance Approval to allow for the proposed development and use of an expansion to the existing loading area to be used by the existing PODs operation, in order to permit additional outdoor storage of stacked, empty PODs units, and improve the loading and circulation functions of the existing PODs operation taking place within one half of the 77,469+/- square-foot industrial warehouse building located on an 11.0491+/- acre parcel known as 6 Berry Drive, and identified on the Official Tax Maps for the Township of Hainesport as Block 96, Lot 2.04, within an Industrial (I) Zoning District (the "Property").
Applicant requests Use Variance Approval to permit the outdoor storage of stacked, empty PODs units, where outdoor storage is otherwise not permitted in an Industrial (I) Zoning District. Applicant requests Bulk Variance Approval to permit the minimum setback of the parking area from the side property line to be eight (8) feet, where nine (9) feet is existing and §104-45(A)(11)(b) of the Township Code otherwise requires fifteen (15) feet. To the extent required, Applicant also requests Bulk Variance Approval to permit the existing 76 parking spaces to remain, where 104 would otherwise be required.
During the course of the review of the Application and / or presentation of the Application it is possible that bulk variances, submission waivers, design waivers, interpretations, and/or other exceptions from the requirements of the Hainesport Township Ordinances may be identified or deemed to be necessary to permit approval of the Application as submitted or with such changes as may be requested or accepted by the Board. This notice is to advise you that such additional approvals, variances, submission waivers, design waivers, interpretations, and/or other exceptions may be requested by the Applicant at the time of the Board hearing for this Application.
At the same time of the Board hearing on the Application, the Applicant will request that the Board grant any and all approvals, submission waivers, design waivers, bulk variances, interpretations, and any / all relief necessary to allow for the approval of the Application as submitted, or with such modifications as may be requested or accepted by the Board.
Anyone interested in this Application will have the opportunity to appear in person at the meeting of the Hainesport Township Joint Land Use Board, on Thursday, June 4, 2026, commencing at 6:30PM in the Hainesport Township Municipal Building, located at One Hainesport Centre, 1401 Marne Highway, Hainesport, New Jersey 08036, to present any support for, or objection to, the approval of this Application.
ACTION WILL BE TAKEN AT THIS MEETING. THIS MEETING WILL BE HELD IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT pursuant to N.J.S.A. 10:4-8(b).
The Board may at its discretion, adjourn, postpone, or continue the hearing from time to time, and you are hereby notified that you should make diligent inquiry of the Hainesport Township Joint Land Use Board Secretary concerning such adjournments, postponements, or continuations.
