NOTICE OF INTENT TO ADOPT RULES OF
THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT
The South Florida Water Management District ("District") is proposing to amend Rules 40E-21.631, 40E-21.671, and 40E-21.691, F.A.C., as follows: 1) remove Figures 21-1 through 21-8 from Rule 40E-21.671, F.A.C., and add those same figures to Rule 40E-21.631, F.A.C., where Figures 21-1 through 21-8 are referenced; 2) add clarifying language indicating that Rule 40E-21.691, F.A.C., contains the legal descriptions of the District's water use basins listed in Rule 40E-21.631, F.A.C., which the Governing Board will use when issuing a water shortage warning or declaring a water shortage in all or part of the District; and 3) add sections 373.171 and 373.246, F.S., to the rulemaking authority for Rules 40E-21.631, 40E-21.671, and 40E-21.691, F.A.C. The District is not proposing any changes to the legal descriptions of the District's water use basin boundaries.
On May 14, 2026, the District's Governing Board authorized District staff to publish a Notice of Proposed Rule and adopt the proposed amendments to Rules 40E-21.631, 40E-21.671, and 40E-21.691, F.A.C. Any affected person may request a public hearing on the rules within 21 days of the date the Notice of Proposed Rule is published in the Florida Administrative Register. If no request for a public hearing is timely received and no material changes are made to the proposed rules, the District will proceed with filing the proposed rules for adoption with the Department of State.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The District has determined that the proposed rules will not have an adverse impact on small business and is not likely to increase, directly or indirectly, regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. The District has not prepared a Statement of Estimated Regulatory Costs (SERC). The District has determined that the proposed rule is not expected to require legislative ratification.
