In pursuance of an Order of Sale from said Court to me directed, I will offer for advertising beginning on May 26th, 2026 at public auction, in accordance with ORC Section 2329.153, online @ https://franklin.sheriffsaleauction.ohio.gov on Friday, June 26th, 2026 at 9:00 o'clock A.M., and if not then sold, on July 17th, 2026 at 9:00 o'clock A.M., the following described real estate, Situated in the State of Ohio, County of Franklin, and in the City of New Albany:
Parcel 1:
Being Lot 40, Section 4, Township 2, Range 16, U.S.M. Lands and Bounded and described as follows:
Beginning at a point where the centerline of the New Albany-Condit Road intersects the North line of Lot 40; Thence along the centerline of said road, South 34 deg. east 127.36 feet to a point;
Thence West (passing an iron pipe at 26.6 feet) 311 feet to an iron pipe in the East line of the Jesse 0. and Lizzie Swickard tract;
Thence along said line, North 1 deg. 10' East 108.49 feet to a concrete comer post;
Thence along the North line of Lot 40, South 88 deg. 56' East (passing an iron pipe at 210.65 feet) 237.1 feet to the place of beginning, containing 0.675 acres more or less.
Excepting therefrom the following described real estate:
Situated in the Township of Plain, County of Franklin and State of Ohio, and in Section 4, Town 2, Range 16 USM Lands, and bounded and described as follows:
Being a parcel of land lying on the West side of the S.R. 605 in the centerline of a survey made by the Department of Transportation, and recorded in Book Page of the records of Franklin County and being located within the following described points in the boundary thereof;
Beginning at a point where the existing centerline of State Route No. 605 intersects the north line of Section 4, and said point being 142.07 feet right of station 1112+16.93 in the centerline of a survey made in 1992 by Jones-Stuckey Ltd., Inc. of State Route No. 161, Section (16.75) in Franklin County, said point also being 41.29 feet left of station 34+61.75 in the centerline of proposed State Route No. 605, said point also being the grantor's Northeasterly property comer;
Thence with the grantor's easterly line and the existing S.R. 605 centerline South 32 deg. 01' 46" East a distance of 249.75 feet to a point on the grantor's southerly line being
24.40 feet left of station 32+11.75 in the proposed centerline of S.R. 605;
Thence with grantor's southerly line North 87 deg. 48' 52" West (passing an iron pipe found at 27.46 feet) a distance of 56.38 feet to an iron pipe set on the proposed westerly right-of-way line for S.R. 605, said point being 73.59 feet left of station 32+39.67 in the
proposed centerline of S.R. 605;
Thence along said westerly right-of-way line North 29 deg. 23' 07'' West a distance of
242.66 feet to an iron pipe set on the grantor's northerly line, said northerly line also being the proposed southerly Limited Access Right-of-Way line for State Route No. 161, said point also being 78.15 feet left of station 34+83.89 in the proposed centerline of S.R. 605;
Thence with grantor's northerly line S. 87 deg. 31' 02" East (passing an iron pipe found at 17.39 feet) a distance of 43.00 feet to the place of beginning, containing 0.235 acres, more or less, inclusive of the present road which occupies 0.114 acres, more or less.

0.059 acres, more or less, is taken from Auditor's Parcel No. 222-434 which contained 0.675 acres, more or less, and a gross taken of 0.121 acres, more or less, inclusive of the present road, which occupies 0.055 acres, more or less, is taken from Auditor's Parcel No. 222-449 which contained 0.792 acres, more or less.
This description is based on a survey made by Dwight D. Stuckey, Registered Surveyor No. 4992, in 1992, from Right-of-Way Plans prepared by Jones-Stuckey Ltd., Inc. The bearings for this description were based on the Ohio State Plane Coordinate Systems,
South Zone and the North American Datum of 1927.

Terms of sale: First Sale - To be sold at https://franklin.sheriffsaleauction.ohio.gov for not less than two-thirds of the appraised value.
Second Sale - If the property does not sell at the first auction, a second sale of this property will be held on July 17th, 2026. The second sale shall be made without regard to the minimum bid requirements in ORC Section 2329.20, but shall be subject to costs, allowance and taxes under ORC Section 2329.21.
