NOTICE OF ADOPTION OF RESOLUTION SUBJECT TO PERMISSIVE REFERENDUM

AUTHORIZATION OF THE PROPOSED USE AND TRANSFER OF OPEN SPACES CAPITAL RESERE FUNDS FOR THE ACQUISITION OF REAL PROPERTY FOR OPEN SPACE PRESERVATION PURPOSES
NOTICE IS HEREBY GIVEN that at a regular meeting held on May 18, 2026, the Canandaigua Town Board duly adopted a resolution authorizing the transfer of funds not to exceed $1,020,000.00 from the Open Space Capital Reserve Fund (AA234) into the Purchase of Land Capital Outlay account AA100.1940.200.00000 pursuant to General Municipal Law §6-c. This transfer will be used to fund the acquisition of the following real property interests:
1.
Approximately forty (40) acres to be subdivided from Tax Map Parcel No. 139.00-1-26.100, with an address of 4765 Seneca Point Road;
2.
Approximately eighteen (18) acres of lands associated with Tax Map Parcel No. 139.00-1-24.111, including lands along the creek corridor connecting existing Town-owned properties
The Town anticipates receiving a private donation in the amount of $400,000 and reimbursement funding from the New York State Department of Environmental Conservation, estimated at approximately 75% of eligible acquisition costs. These reimbursement funds will be deposited back into the Open Space Capital Reserve Fund once received on future date, which would restore the reserve to an estimated balance in excess of $700,000 leaving an actual cost to the Town of approximately $370,000 for this land acquisition.
Said resolution was adopted subject to a permissive referendum as provided in Article 7 of the New York Town Law (§§90–94) and General Municipal Law §6-c. Petitions must be filed with the Office of the Town Clerk within thirty (30) days after the date of adoption of the resolution. Any such petition must conform to the requirements of Town Law §91, including the number of signatures required.
If a valid petition is filed, a referendum will be held on the question of the transfer. If no valid petition is filed, the Town Board's resolution shall take effect without further action.
