NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by Joseph Heath to Wells Fargo Bank, N.A. dated September 16, 2011, and recorded in Deed Book 372I, Page 774, Chatham County Records, securing a Note in the original principal amount of $116,412.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, July 7, 2026, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that certain lot, tract or parcel of land situate, lying and being in the County of Chatham, State of Georgia known as Lot Number Two Hundred Fifteen (215), Paradise Park Subdivision, Phase Four(4). Said lot hereby conveyed has a frontage of one hundred and twelve hundredths (100.12) feet, a depth Northwardly along its eastern boundary of one hundred twenty-five (125) feet, and a width across the rear of one hundred ten (110) feet. Said lot is generally bounded northwardly by Lot 167, Phase 3, Paradise Park Subdivision; eastwardly by Dyches Drive; Southwardly by Keystone Drive; and Westwardly by Lot 217, Paradise Park Subdivision, Phase 4. Specific reference is made to map of said subdivision of Paradise Park, Phase 4, recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia, in Subdivision Map Book A, Page 283, which map is expressly made a part of this description.
Subject, however, to all covenants, valid restrictions, taxes for the current year, easements and rights-of-way of record.
This being the same property conveyed by Warranty Deed dated September 29, 1993 from Corrie T. Bartell to Joseph W. Heath, and recorded in the Office of the Clerk of the Superior Court of Chatham County, Georgia in Deed Record Book 162 N, Folio 465.
Said property is known as 513 Dyches Dr, Savannah, GA 31406, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of Joseph Heath c/o Tyler Dion Heath, a/k/a Joseph W. Heath, successor in interest or tenant(s).
