NOTICE is hereby given that on May 8, 2026, Isaac Villegas, P.O. Box 1436 Hatch, NM 87937 filed with the STATE ENGINEER Application No. LRG-13712-POD2, OSE File No. LRG-13712-1, for Permit to Drill and Use a Supplemental Well within the Lower Rio Grande Underground Water Basin of the State of New Mexico by drilling new well LRG-13712-POD2, to a depth of 100 ft. with a 12 in. casing, to be located within the SE¼ SE¼ of Section 10, Township 19 South, Range 3 West (NMPM), and more specifically located where Latitude and Longitude intersect at 32° 39' 58.57" N, 107° 7' 46.44" W (WGS84), on land owned by the applicant, to supplement existing well LRG-13712-PODl, located within the SE¼ SE¼ of Section 10, Township 19 South, Range 3 West (NMPM), and more specifically located where Latitude and Longitude intersect at 32° 39' 58.65" N, 107° 7' 46.94" W (WGS84), on land owned by the applicant, for the continued diversion of the amount of water subject to all conditions and provisions contained in the August 22, 2011 Final Judgment and Settlement Agreement in Stream System Issue No. 101, SS-97-101, combined with surface water from the Elephant Butte Irrigation District for the irrigation of 14.46 acres of land, owned by the applicant, located within the SE¼ of Section 10, Township 19 South, Range 3 West (NMPM) as described by Subfile Order No. LRR-28-007-0026, Right A of the Third Judicial District Court, Dona Ana County, State of New Mexico.
The applicant has requested emergency authorization to drill the proposed well under NMSA, 1978, Section 72-12-24.
The proposed site of new well LRG-13712-POD2 is located east of Hatch, NM and is approximately 1,385 ft. west of the intersection of Rutledge Rd. and Railroad Rd.
Dona Ana is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Las Cruces Sun News.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 1680 Hickory Loop, Suite J, Las Cruces, NM 88005 on or before July 24, 2026. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, at 575-524-6160. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
