The object of this action is to seek a declaratory judgment to quiet title to the subject premises pursuant to Article 15 and Article 19 of the Real Property Actions and Proceedings Law. Plaintiff is seeking a judgment declaring that: (i) Guaranteed Home Mortgage Co., and its successors and assigns (other than Plaintiff), retain no rights or interest in and to the Mortgage dated June 23, 2003, and recorded in the Office of the Orange County Clerk on July 1, 2003, in Mort / Bk 11106, Pg 0364, File Number 20030092288, and (ii) that Plaintiff, and its successors and/or assigns, shall thereafter be considered the mortgagee of the Mortgage for all legal purposes.
