SUMMONS
The basis of the venue designated is the County of Orange, as the Property that is the subject of this action is located in Orange County, New York.
WELLS FARGO BANK, N.A. SUCCESSOR BY MERGER TO WELLS FARGO HOME MORTGAGE, INC., Plaintiff, -v- GUARANTEED HOME MORTGAGE CO., Defendant, and EDWARD CALLIS, Party in Interest. TO THE ABOVE-NAMED DEFENDANT AND PARTY IN INTEREST: YOU ARE HEREBY SUMMONED and required to serve upon Plaintiff's attorneys an answer to the Complaint in this action within twenty (20) days after the service of this Summons, exclusive of the day of service (or within thirty days after service is completed if the Summons is not personally delivered to you within the State of New York); and in case of your failure to answer, judgment will be taken against you by default for the relief demanded in the Complaint. The foregoing Summons is served upon you by publication pursuant to an Order for Service by Publication of the Honorable Kyle C. McGovern, a Justice of the Supreme Court of the State of New York, Orange County, granted on May 15, 2026, and filed with the Complaint and other papers in the office of the County Clerk of Orange County. The object of this action is to seek a declaratory judgment to quiet title to the subject premises pursuant to Article 15 and Article 19 of the Real Property Actions and Proceedings Law. Plaintiff is seeking a judgment declaring that: (i) Guaranteed Home Mortgage Co., and its successors and assigns (other than Plaintiff), retain no rights or interest in and to the Mortgage dated June 23, 2003, and recorded in the Office of the Orange County Clerk on July 1, 2003, in Mort / Bk 11106, Pg 0364, File Number 20030092288, and (ii) that Plaintiff, and its successors and/or assigns, shall thereafter be considered the mortgagee of the Mortgage for all legal purposes. Said subject premises being known as and by street address 16 Waterford Circle, Washingtonville, New York 10992, bearing tax map designation Section: 102, Block: 2, Lot: 15, which is more fully described in the Schedule "A" attached to the Complaint.
