NOTICE OF BOND RELEASE In accordance with KRS 350.093, notice is hereby given that ERP Environmental Fund, Inc. (ERPEF), 216 School Drive, Shrewsbury, West Virginia 25015, has applied for Phases II and III bond releases on Increment 13 of Permit No. 851-0053, which was last issued on 25 July 2025 (Permit No. 851-0053 MA-12). The application covers a total area of 22.40 acres, located approximately 0.75 mile west of Hebbardsville in Henderson County. The permit area is located approximately 0.75 mile west of the KY 351 junction with KY 416, approximately 0.75 mile north of Audubon Parkway Exit 10, and adjacent to Lick Creek. The reclamation bond now in effect for Increment 13 is surety bond #N-112023-851-0053-13 for $29,750.00, all of which (100%) is included in the application for release. The steps toward achieving this bond release include the following: (1) Revegetation has been established in accordance with the approved reclamation plan and the standards for success of revegetation have been met. (2) The lands are not contributing suspended solids to stream flow or runoff outside the permit area or increment in excess of regulatory requirements. (3) There has been successful completion of all surface coal mining and reclamation operations in accordance with the approved reclamation plan, such that the land is capable of supporting the approved postmining land use (recreation). (4) There has been achievement of compliance with the requirements of KRS Chapter 350, Title 405, Chapters 7 through 24, and the permit. Written comments, objections, and requests for a public hearing or informal conference must be filed with the Director, Division of Mine Reclamation and Enforcement, 300 Sower Boulevard, Frankfort, Kentucky 40601, by Thursday, 23 July 2026. A public hearing on the application has been scheduled for Tuesday, 28 July 2026 at 9:00 A.M. at the Kentucky Department for Natural Resources (KDNR), Madisonville Regional Office, 625 Hospital Drive, Madisonville, Kentucky 42431-1683. The hearing will be cancelled if no request for a hearing or informal conference is received by Thursday, 23 July 2026.
