NOTICE OF DECISION
THE BOROUGH OF SURF CITY
LAND USE BOARD
TAKE NOTICE that on the 27th day of May 2026, the Borough of Surf City Land Use Board (the "Board") adopted Resolution of Memorialization App. #25-07: Ziman Development (the "Applicant"), Block 91, Lots 20, 22, 24 &24.01; 258 N. 23rd Street in the Borough of Surf City. The Applicant sought an interpretation as to whether any variance relief was required from the Board pursuant to N.J.S.A. 40:55D-35, or any applicable provisions of the Surf City Zoning Ordinance, relative to the construction of a new single-family dwelling at the property. In the event the Board were to determine that variance relief was required, the Applicant would have requested any applicable variances. The Board ultimately concluded that no variance relief was required relative to the single-family dwelling currently under construction at the property, that the Applicant met all of the bulk requirements of the Surf City Borough Code, and that the zoning permit issued by the Surf City Zoning Officer relative to the construction of the single-family dwelling met the building requirements of the Borough Code.
A public hearing was held during the course of multiple Board meetings occurring on December 17, 2025; January 28, 2026; February 25, 2026; March 25, 2026; March 30, 2026; April 22, 2026; and April 29, 2026. A copy of the Resolution has been filed and is available for inspection at the Land Use Board Office.
