NOTICE OF SALE UNDER POWER OF DEED OF TRUST
TENNESSEE, KNOX COUNTY
By virtue of the power of sale contained in the Tennessee Deed of Trust from George Fikes, LLC an Oklahoma limited liability company (“Grantors”), to A. Christopher White, Trustee (“Trustee”) for the benefit of Peoples Bank of East Tennessee (“Bank”), the Deed of Trust having been given to secure the obligations of Grantor to Bank, including without limitation, the obligations evidenced by a promissory note from Grantor to Bank, dated July 20, 2020, in the original principal amount of $71,250.00, with interest from the date thereof at the rate specified, and a second promissory note from Grantor to Bank, dated November 6, 2023, (the “Notes”). The original Deed of Trust has been recorded July 21 2020, at Instrument #202007210005747, and in the second Deed of Trust recorded November 21, 2023 at Instrument #202311210026177 as of respectively, in the Register’s Office of Knox County, Tennessee, as may have been amended. The undersigned will sell at public outcry to the highest and best bidder for cash on July 1, 2026, at 11:00 a.m. at the front door (Main Street entrance) of the Knox County Courthouse (300 Main Street), Knoxville, Tennessee, all or parts of real property known and designated as 2104 E Magnolia Avenue, Knoxville, Knox County Tennessee, more specifically described as:
SITUATED in District No. One (1) of Knox County, Tennessee, within the 14th Ward of the City of Knoxville, Tennessee, and being known and designated as Lot 19-R in the Resubdivision of Lot 17, 18 and 19, Sarah Ann Blang's Addition, as shown by plat filed for record in Plat Cabinet F, Slide 112-A (formerly Map Book 80-S, page 48) in the Knox County Register of Deeds Office, to which plat specific reference is hereby made for a more particular description.
BEING the same property conveyed to George Fikes, LLC, an Oklahoma limited liability company, Warranty Deed from Robert A. Whaley, dated July 20, 2020, filed for record as Instrument No. 202007210005746 in the Knox County Register of Deeds Office.
The obligations secured by the Deed of Trust have been and are hereby declared due and payable because of default under the terms of the Deed of Trust and the Note, including but not limited to, the failure to make payments when due. The obligations remaining in default, this sale will be made for the purpose of applying the proceeds to the payment of the obligations secured by the Deed of Trust, accrued interest and expenses of the sale and all other payments provided for under the Deed of Trust, notice of intention to collect attorneys’ fees having been given as provided by law; and the remainder, if any, shall be applied as provided by law.
The Property will be sold as the property of George Fikes, LLC, who, to the best of Bank’s knowledge and belief, is the party in possession of the Property.
The Property will be sold “As Is,” without express or implied warranties of any kind, subject to (a) all unpaid real and personal property ad valorem taxes and governmental assessments, and (b) all prior restrictions, rights–of–way, easements and assessments of record, if any, appearing of record prior to the date of the Deed of Trust and those appearing after the date of the Deed of Trust and consented to of record by Bank, as applicable.
