In execution of a Deed of Trust in the original amount of $115,000.00, dated January 7, 2005, and recorded as Instrument No. 050000452 in the land records of the County of Augusta, Virginia, default having been made in the payments of the indebtedness thereby secured, the undersigned will on
July 28, 2026 @ 2:30 PM
at the front entrance of the Augusta County Circuit Courthouse, 100 Dick Huff Lane, Verona, VA 24482, offer for sale at public auction the property and improvements thereon, described as follows:
FIRST: All that certain tract or parcel of land, with all improvement thereon and all rights, privileges and appurtenances thereto belonging, situate in Riverheads District of Augusta County, Virginia, containing 0.826 acre and more particularly described according to "Map of a Portion of the Kay N. Davenport Prop.," dated May 19, 1983, made by R. E. Funk, LS., said plat being duly of record in the Clerk's Office of the Circuit Court of Augusta County, Virginia, in Deed Book 796, Page 177. There is specifically included in this conveyance, as appurtenance to the above described real estate, an exclusive easement or right of way 20' in width, running from said real estate to State route 682, and more particularly described and located as lying between the broken lines as designated on the aforesaid plat.
SECOND: All that certain tract or parcel of land, with all improvements thereon and all rights, privileges and appurtenances thereto belonging, situate in Riverheads District of Augusta County, Virginia, containing 0.519 acre, and more particularly describe according to a plat entitled "Map of a Portion of the Kay N. Davenport Property," dated October 3, 1984, made by R. E. Funk, land Surveyor, said plat being attached to and recorded with a deed dated April 10, 1985 of record in the aforesaid Clerk's Office in Deed Book 838, Page 459.
TERMS OF SALE: CASH
This sale is subject to all matters of record in the chain of title to the above property, and also subject to mechanics' and materialmen's liens of record and not of record, if any such liens exist.
A bidder's deposit of 10% of bid amount, in cash, certified or cashier's check, is required at the time of sale, with the balance due at settlement, to be held within 30 days from the sale date at the office of the Trustee. The property and improvements thereon shall be sold in "as is" condition. All costs of conveyance, by special warranty deed, will be at the cost of the purchaser. Real estate taxes shall be prorated to date of sale. Additional terms of sale shall be announced at the time of sale and contained in a memorandum of sale which the successful bidder shall be required to sign.
