RESOLUTION NO. 6002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, ORDERING AND CALLING FOR THE SUBMISSION TO VOTERS AT THE NOVEMBER 3, 2026 GENERAL ELECTION PROPOSED AMENDMENTS TO ARTICLE II, SECTION 2.05 OF THE CITY CHARTER CONFORMING “RESIGN TO RUN” PROVISIONS TO STATE LAW; DIRECTING PUBLICATIONS AS REQUIRED BY LAW; DESIGNATING THE PLACE AND TIME TO ACCEPT ARGUMENTS FOR AND AGAINST THE QUESTION; ESTABLISHING THE CONDUCT OF ELECTIONS INCLUDING BALLOT TABULATION REQUIREMENTS; AUTHORIZING AN AGREEMENT FOR SERVICES WITH THE COUNTY AND PAYMENT OF ELECTION EXPENDITURES; SETTING FORTH THE VOTER REGISTRATION DEADLINE AND VOTER RIGHTS ACT REQUIREMENTS; ESTABLISHING CANVASSING AND REPORTING REQUIREMENTS; AND INCLUDING A SEVERABILITY AND RATIFICATION CLAUSE. WHEREAS, on June 12, 2025, the city council adopted Ordinance 5132 forming a City Charter Amendment Resident Advisory Committee to review the city charter and make recommendations to the city council regarding potential charter amendments; and WHEREAS, the City Charter Amendment Resident Advisory Committee presented its recommendations to the city council at a work session held February 2, 2026, and the city council further considered the committee’s recommendations at a second work session held April 6, 2026; and WHEREAS, the city council desires to propose amendments to the city charter conforming the charter’s “resign to run” provisions with state law as recommended by the City Charter Amendment Resident Advisory Committee and as shown on Exhibit “A” hereto; and WHEREAS, it is necessary for the city council to submit the proposed charter amendments to the qualified electors of the city; and WHEREAS, the city council may consolidate the charter amendment election with the general election conducted in the City on November 3, 2026. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chandler, Arizona, as follows: Section 1. That the proposed amendments to the City Charter for the City of Chandler attached hereto as Exhibit “A” and by reference made a part hereof, be submitted to the vote of the qualified electors of the city at the general election to be held on November 3, 2026. Section 2. Order and Call for Election; Ballot. Pursuant to Sections 7.03 and 10.09 of the City Charter for the City of Chandler and Article 13, Section 2 of the Arizona  Constitution, a charter election in the city is hereby ordered and called to be held on November 3, 2026, to submit to the qualified electors of the city the proposed amendments to the city charter shown on Exhibit A. The form of Ballot is attached hereto as Exhibit “B” and incorporated herein. Section 3. Publications; Informational Pamphlet. The city clerk is hereby directed to cause the preparation and distribution of any required publications as required by law including an informational pamphlet and sample ballot pursuant to, and meeting the requirements of, A.R.S. § 19-141 and Section 7.03 of the city charter and, if the city clerk determines it to be in the city’s best interests, combine such informational pamphlet and sample ballot with any other publicity pamphlet being prepared for the November 3, 2026 general election. The officers of the city are hereby authorized to prepare and deliver, or cause to be prepared and delivered, to the city clerk the information necessary or appropriate for completing the informational pamphlet. The informational pamphlet is to be mailed before the earliest date of receipt of a requested early ballot to the residence of each registered voter of the city as shown on the general county register. Section 4. Arguments; Notice and Submittal. Pursuant to A.R.S. § 19-141(C), the city hereby sets the date of Wednesday, August 5, 2026, at the hour of 5:00 p.m. as the deadline to submit arguments “for” or “against” the proposed charter amendments. Each argument shall not exceed 300 words in length, and $150.00 shall be deposited with the city clerk, 175 S. Arizona Avenue, 1st Floor, by the person submitting each argument, to offset a portion of the proportionate cost of paper and printing the argument. The city clerk is authorized to publish in a newspaper of general circulation within the city a notice stating the deadline for filing with the city arguments “for” or “against” the charter amendments, for inclusion in the informational pamphlet pertaining to the amendments. The city clerk is authorized to prepare the notice as necessary to comply with all applicable laws. Section 5. Conduct of Election; Designating Election Format; Contracts; Expenditures. The election will be conducted in the manner provided by law, and the poll lists kept, and the votes cast will be counted and tabulated, and the returns thereof will be made in the manner provided by law and only persons who are qualified electors of the city will vote at the city charter election. The charter election may be consolidated with any other election conducted in the city on November 3, 2026. A ballot box for drop-off will be available at Chandler City Hall, 175 S. Arizona Avenue. Ballots shall be counted by the voting system in use by the Maricopa County Elections Department for the recordation of the electors’ choices as authorized by Arizona law. The mayor and the city clerk or either of them is each hereby authorized and directed to enter into a contract with the Maricopa County Recorder to obtain precinct registers for the election and to enter into an agreement with the Maricopa County Elections Department to conduct the charter election for the city. The city council hereby authorizes all expenditures as may be necessary to order, notice, hold and administer the charter election, which expenses shall be paid from current operating funds of the city. The city clerk is hereby authorized to take all necessary action to facilitate the charter election. Section 6. Deadline for Voter Registration and Early Voting Dates. A voter in this charter election must be a qualified elector of the city. Maricopa County registration and voting lists will be used for the charter election. To be qualified to vote in the special election, a city resident must be registered to vote by midnight on October 5, 2026. Early voting with respect to the charter election will be permitted in accordance with the provisions of A.R.S. Title 16, Chapter 4, Article 8. Section 7. Voting Rights Act and Spanish Translation. To comply with the Voting Rights Act of 1965, as amended, the proceedings pertaining to this election will be translated into Spanish and posted, published, distributed, and/or recorded in each instance where posting, publication, distribution, and/or recording of such proceedings are required, such as this call of election, the notice of election, ballots, the request for arguments, the informational pamphlet, all early voting materials and all instructions relating thereto. Section 8. Canvass of Election; Reporting. The election officials will forward the votes cast to the city council for canvassing. The city council will meet at the council chambers on a day that is within 20 days after the election date to canvass the returns of the election and to certify the result, as provided by Arizona law. The city clerk is authorized and directed to file and record a certificate of result of election in the office of the Maricopa County Recorder: (i) disclosing the purpose of the election, (ii) the total number of votes cast and the total number of votes for and against the proposed charter amendments and (iii) stating whether the amendment is ordered. On filing and recording the certificate, the city council will carry out the purpose of the charter election. Section 9. Severability. If any section, paragraph, clause or phrase of this resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or phrase shall not affect any of the remaining provisions of this resolution. The city council hereby declares that the city would have adopted this resolution and each and every other section, paragraph, subdivision, sentence, clause or phrase hereof and authorized and approved the actions of the city pertaining to the election pursuant hereto irrespective of the fact that any one or more sections, paragraphs, subdivisions, sentences, clauses or phrases of this resolution may be held illegal, invalid or unenforceable. Section 10. Ratification. All actions of the city council, officers, employees and agents of the city which are in conformity with the purposes and intent of this resolution, whether heretofore or hereafter taken, shall be and are hereby ratified, confirmed, authorized and approved. Prohibitions. (a) Holding other office. Except where authorized by law, no councilman shall hold any other elected public office or city employment during the term for which he was elected to the council. (1) In the event a councilman whose term of office will not expire until after the date the next mayor takes office wishes to run for the office of mayor, he THEY shall resign from office when he takes out UPON FILING THEIR nomination papers from WITH the office of the city clerk or one hundred five (105) days prior to the primary election, whichever first occurs. The vacancy so created shall be temporarily filled by a majority vote of the remaining members of the council who shall appoint a qualified elector to serve until the first regular meeting of the city council in March following the forthcoming election. NOTWITHSTANDING SECTIION 2.06(c), Iif the council fails to make such an appointment within thirty (30) days of the occurrence of the resignation, the seat shall remain vacant until the forthcoming election. The unexpired term of the vacancy which occurs as a result of any councilman who resigns to run for the office of mayor shall be filled at the forthcoming election. A qualified elector running for the unexpired term shall so state in such elector's nomination papers. (2) No former mayor or councilman shall hold any compensated appointive city office or employment until two (2) years after the expiration of the term for which he was elected or appointed to the council or until he ceases to occupy the office of councilman or mayor. (b) Appointments and removals. Neither the council nor any of its members shall in any manner dictate the appointment or removal of any city administrative officers or employees whom the manager or any of his subordinates are empowered to appoint, but the council may express its views and fully and freely discuss with the manager anything pertaining to appointment and removal of such officers and employees. (c) Interference with administration. Except for the purpose of inquiries or investigations authorized under section 2.11 of this Charter, the council or its members shall deal with city officers and employees who are subject to the direction and supervision of the manager solely through the manager, and neither the council nor its members shall give any orders to any such officer or employee, either publicly or privately. (d) Strikes and binding arbitration prohibited. Strikes by municipal employees in the City of Chandler are strictly prohibited in order to insure the safe and orderly delivery of services as well as the protection of lives and public safety. The City of Chandler and its employees have an obligation to the public to assure the orderly and continuous operation and function of city government. The citizens of Chandler have a fundamental interest in the development of harmonious and cooperative relations between city government, its managers, and its employees. The principle and procedure of full communication between the City and its employees or their representatives can alleviate various forms of strife and unrest. In order to promote harmonious relations within city government, the City, its employees and their representatives, acting within the framework of law, may enter into discussions with affirmative willingness relating to department policy, grievances, wages, hours and other conditions of employment. It is in the public interest to promote the improvement of employer/employee relations by providing a rational structure to resolve differences and enter into agreements through a "Meet and Confer" process. The Meet and Confer process shall provide for formal discussion between the city manager or his/her representative and representatives of employees in a given department or departments if a majority of such employees have designated an employee organization to represent them. The results of those discussions shall be submitted to the Mayor and Council for their approval, rejection or modifications. The decision of the Mayor and Council shall be final and binding on all parties. To the extent that agreements are reached, they shall continue until or unless modified by the parties involved. The process and procedure for a "Meet and Confer" process shall be developed by the Mayor and Council. CONSIDERANDO QUE, el 12 de junio de 2025, el concilio de la ciudad adoptó la Ordenanza 5132 formando un Comité de Asesoría de los Residentes para Enmendar los Estatutos de la Ciudad para revisar los estatutos de la ciudad y hacer recomendaciones al concilio de la ciudad sobre enmiendas potenciales a los estatutos; y CONSIDERANDO QUE, el Comité de Asesoría de los Residentes para Enmendar los Estatutos de la Ciudad presentó sus recomendaciones al concilio de la ciudad en una sesión de trabajo llevada a cabo el 2 de febrero de 2026, y que el concilio de la ciudad consideró más a fondo las recomendaciones del comité en una segunda sesión de trabajo llevada a cabo el 6 de abril de 2026; y CONSIDERANDO QUE, el concilio de la ciudad desea proponer enmiendas a los estatutos de la ciudad conformando las disposiciones de “renuncia para postularse” con la ley del estado tal y como lo recomienda el Comité de Asesoría de los Residentes para Enmendar los Estatutos de la Ciudad y como se muestra en la Prueba “A” de este documento; y CONSIDERANDO QUE, es necesario que el concilio de la ciudad presente las enmiendas propuestas a los estatutos a los electores cualificados de la ciudad; y CONSIDERANDO QUE, el concilio de la ciudad puede consolidar la elección de enmienda a los estatutos con la elección general que se llevará a cabo en la Ciudad el 3 de noviembre de 2026. AHORA, POR LO TANTO, QUE SEA RESUELTO por el Concilio de la Ciudad de la Ciudad de Chandler, Arizona, como sigue: Sección 1. Que las enmiendas propuestas a los Estatutos de la Ciudad para la Ciudad de Chandler, adjuntas a esto como la Prueba “A” y por referencia incluidas como parte de la misma, sean presentadas para la votación de los electores cualificados de la ciudad en la elección general que se llevará a cabo el 3 de noviembre de 2026. Sección 2. Orden y Convocatoria para la Elección; Boleta Electoral. En conformidad con las Secciones 7.03 y 10.09 de los Estatutos de la Ciudad para la Ciudad de Chandler y el Artículo 13, Sección 2 de la Constitución de Arizona, por este medio se ordena y convoca una elección de estatutos en la ciudad sobre los estatutos para que se lleve a cabo el 3 de noviembre de 2026, para presentar a los electores cualificados de la ciudad las enmiendas propuestas a los estatutos de la ciudad que aparecen en la Prueba A. La forma de la Boleta Electoral se adjunta a esto como Prueba “B” y se incorpora a la presente. Sección 3. Publicaciones; Folleto Informativo. Por este medio se ordena a la escribana de la ciudad que cause la preparación y distribución de cualquier publicación requerida como por ley incluyendo un folleto informativo y una boleta electoral de muestra en conformidad con, y en cumplimiento de los requerimientos de los estatutos A.R.S. § 19-141 y la Sección 7.03 de los estatutos de la ciudad y, si la escribana de la ciudad determina que es en el mejor interés de la ciudad, combinar dicho folleto informativo y boleta electoral de muestra con cualquier otro folleto informativo que se esté preparando para la elección general del 3 de noviembre de 2026. Por este medio se autoriza a los funcionarios de la ciudad para que preparen y entreguen, o que hagan que se prepare y entregue, a la escribana de la ciudad la información necesaria o apropiada para completar el folleto informativo. El folleto informativo se debe enviar por correo postal antes de la fecha más temprana de recepción de una boleta electoral temprana solicitada a la residencia de cada elector registrado de la ciudad como se muestre en el registro general del condado. Sección 4. Argumentos; Aviso y Presentación. En conformidad con el estatuto A.R.S. § 19-141(C), por medio de la presente la ciudad fija la fecha del miércoles 5 de agosto de 2026, a las 5:00 p.m. como la fecha límite para presentar argumentos “a favor” o “en contra” de las enmiendas propuestas a los estatutos. Cada argumento no deberá exceder 300 palabras de largo, y se deberán depositar $150.00 con la escribana de la ciudad, 175 S. Arizona Avenue, 1er Piso, por la persona presentando cada argumento, para compensar una porción del costo proporcional del papel y de la impresión del argumento. La escribana de la ciudad está autorizada para que publique en un periódico de circulación general dentro de la ciudad un aviso estableciendo la fecha límite para registrar con la ciudad los argumentos “a favor” o “en contra” de las enmiendas a los estatutos, para su inclusión en el folleto informativo relacionado con las enmiendas. La escribana de la ciudad está autorizada a preparar el aviso según sea necesario para cumplir con todas las leyes aplicables. Sección 5. Llevar a Cabo la Elección; Designando el Formato de la Elección; Contratos; Gastos. La elección se llevará a cabo en la manera establecida por la ley, y se mantendrán las listas electorales, y los votos emitidos serán contados y tabulados, y los resultados de la misma se realizarán en la manera establecida por la ley, y sólo personas que sean electores cualificados de la ciudad votarán en la elección de los estatutos de la ciudad. La elección de los estatutos se podrá consolidar con cualquier otra elección llevada a cabo en la ciudad el 3 de noviembre de 2026. Habrá un buzón de entrega en el edificio municipal Chandler City Hall, 175 S. Arizona Avenue. Las boletas electorales deberán ser contadas por el sistema de votación utilizado por el Departamento de Elecciones del Condado Maricopa para el registro de las elecciones de los electores como esté autorizado por la ley de Arizona. El alcalde y la escribana de la ciudad o cualquiera de ellos están autorizados y dirigidos cada uno a celebrar un contrato con el Registrador del Condado Maricopa para obtener los registros de los distritos electorales para la elección y para celebrar un acuerdo con el Departamento de Elecciones del Condado Maricopa para llevar a cabo la elección de los estatutos para la ciudad. El concilio de la ciudad por medio de la presente autoriza todos los gastos que puedan ser necesarios para ordenar, avisar, celebrar y administrar la elección de los estatutos, cuyos gastos deberán ser pagados con fondos operativos actuales de la ciudad. Se autoriza a la escribana de la ciudad por medio de la presente para que tome todas las medidas necesarias para llevar a cabo la elección de los estatutos. Sección 6. Fecha límite para el Registro Electoral y Fechas para la Votación Temprana. Un votante en esta elección de los estatutos debe ser un elector cualificado de la Ciudad. Las listas de registro y votación del Condado Maricopa se usarán para la elección de los estatutos. Para cualificar para votar en la elección especial, un residente de la Ciudad debe estar registrado para votar antes de la medianoche del 5 de octubre de 2026. Se permitirá la votación temprana con respecto a la elección de los estatutos en conformidad con las disposiciones del estatuto A.R.S. Título 16, Capítulo 4, Artículo 8. Sección 7. Decreto de los Derechos Electorales y Traducción a Español. Para cumplir con el Decreto de los Derechos Electorales de 1965, tal como fue enmendado, los procedimientos relacionados con esta elección se traducirán a español y se anunciarán, publicarán, distribuirán, y/o se grabarán en cada instancia en la que se requiera que se anuncien, publiquen, distribuyan, y/o se graben dichos procedimientos, tal como esta convocatoria de elección, el aviso de la elección, las boletas electorales, la solicitud de argumentos, el folleto informativo, todos los materiales de votación temprana y todas las instrucciones relacionadas a ello. Sección 8. Escrutinio de la Elección; Reportando. Los funcionarios electorales enviarán los votos emitidos al concilio de la ciudad para su escrutinio. El concilio de la ciudad se reunirá en las cámaras del concilio en un día que esté dentro de 20 días posteriores a la fecha de la elección para realizar un escrutinio de los retornos de la elección y certificar el resultado, como está dispuesto por la ley de Arizona. La escribana de la ciudad está autorizada y se le ordena para que presente y registre un certificado del resultado de la elección en la oficina del Registrador del Condado Maricopa: (i) revelando el propósito de la elección, (ii) el número total de votos emitidos y el número total de votos a favor y en contra de la creación de las enmiendas propuestas a los estatutos y (iii) declarando si la enmienda es ordenada. Al presentar y registrar el certificado, el concilio de la ciudad llevará a cabo el propósito de la elección de los estatutos. Sección 9. Divisibilidad. Si cualquier sección, párrafo, cláusula o frase de esta resolución se deberá considerar inválida o inaplicable por cualquier motivo, la invalidez o inaplicabilidad de dicha sección, párrafo, cláusula o frase no deberá afectar a cualquiera de las disposiciones restantes de esta resolución. El concilio de la ciudad declara por medio de la presente que la ciudad hubiese adoptado esta resolución y toda y cada sección, párrafo, subdivisión, oración, cláusula o frase restante de la presente y que autorizó y aprobó las acciones de la ciudad relacionadas con la elección en conformidad con la presente independientemente del hecho de que cualesquier una o más secciones, párrafos, subdivisiones, oraciones, cláusulas o frases de esta resolución pueda considerarse ilegal, inválida o inaplicable. Sección 10. Ratificación. Todas las acciones del concilio de la ciudad, funcionarios, empleados y agentes de la ciudad que están en conformidad con los propósitos y la intención de esta resolución, ya sea que se tomen hasta ahora o en el futuro, deberán ser y por medio de la presente son ratificadas, confirmadas, autorizadas y aprobadas. NO OBSTANTE LA SECCIIÓN 2.06(c), Ssi el concilio falla en hacer dicho nombramiento dentro de treinta (30) días desde la renuncia, el cargo deberá permanecer vacante hasta la elección venidera. El término del mandato no expirado de la vacante que ocurra como resultado de que cualquier concejal renuncie para postularse al cargo de alcalde deberá ser cubierta en la elección venidera. Un elector cualificado postulándose para el término del mandato que no ha expirado deberá indicarlo en los documentos de nominación de dicho elector. (2) Ningún exalcalde o exconcejal deberá ocupar cualquier cargo designado o empleo remunerado en la ciudad sino hasta dos (2) años después de la expiración del término del mandato para el cual fue elegido o nombrado al concilio o hasta que deje de ocupar el cargo de concejal o de alcalde. (b) Nombramientos y destituciones. Ni el concilio ni cualquiera de sus miembros deberá dictar de cualquier manera el nombramiento o la destitución de cualquier funcionario administrativo o empleado de la ciudad a quienes el administrador o cualquiera de sus subordinados estén facultados para nombrar, pero el concilio puede expresar su opinión y considerar plena y libremente con el administrador cualquier cosa relativa al nombramiento y la destitución de dichos funcionarios y empleados. (c) Interferencia con la administración. Salvo para el propósito de indagaciones o investigaciones autorizadas bajo la sección 2.11 de estos Estatutos, el concilio o sus miembros deberán tratar con los funcionarios y empleados de la ciudad que estén sujetos a la dirección y supervisión del administrador únicamente a través del administrador, y ni el concilio ni sus miembros deberán darle cualquier orden a cualesquiera dichos funcionarios o empleados, ya sea en público o en privado. (d) Prohibición de huelgas y arbitraje vinculante. Las huelgas de empleados municipales en la Ciudad de Chandler están estrictamente prohibidas a fin de asegurar la prestación segura y ordenada de los servicios así como la protección de vidas y la seguridad pública. La Ciudad de Chandler y sus empleados tienen la obligación hacia el público de asegurar la operación y el funcionamiento ordenados y continuos del gobierno de la ciudad. Los ciudadanos de Chandler tienen un interés fundamental en el desarrollo de relaciones armoniosas y cooperativas entre el gobierno de la ciudad, sus directivos, y sus empleados. El principio y procedimiento de plena comunicación entre la Ciudad y sus empleados o sus representantes pueden aliviar varias formas de conflictos y disturbios. A fin de promover relaciones armoniosas dentro del gobierno de la ciudad, la Ciudad, sus empleados y sus representantes, actuando dentro del marco legal, pueden tener deliberaciones con disposición afirmativa relacionadas con normas, quejas, salarios, horarios y otras condiciones laborales departamentales. Es en el interés público promover el mejoramiento de las relaciones de empleadores/empleados al proporcionar una estructura racional para resolver diferencias y establecer acuerdos mediante un proceso de “Reunirse y Deliberar”. El proceso de Reunirse y Deliberar deberá prever para la deliberación formal entre el administrador de la ciudad o su representante y los representantes de empleados de un departamento o departamentos dados si una mayoría de dichos empleados ha designado a una organización de empleados para que los represente. Los resultados de esas deliberaciones deberán ser sometidos al Alcalde y al Concilio para su aprobación, rechazo o modificaciones. La decisión del Alcalde y del Concilio deberá ser definitiva y vinculante para todas las partes. En la medida en la que se lleguen a acuerdos, éstos deberán continuar hasta que o a menos que las partes implicadas las modifiquen. El proceso y procedimiento para un proceso de “Reunirse y Deliberar” deberá ser desarrollado por el Alcalde y el Concilio. PRUEBA “B” CIUDAD DE CHANDLER ELECCIÓN DE ENMIENDA A LOS ESTATUTOS 3 DE NOVIEMBRE 2026 PROPOSICIÓN ___ ENMIENDA PROPUESTA A LOS ESTATUTOS DE LA CIUDAD DE CHANDLER POR EL CONCILIO DE LA CIUDAD COMO FUE RECOMENDADO POR EL COMITÉ DE ASESORÍA DE LOS RESIDENTES TÍTULO OFICIAL: Enmendando el Artículo II, Sección 2.05 de los Estatutos de la Ciudad de Chandler con respecto a renunciar para postularse a un cargo. TÍTULO DESCRIPTIVO: La enmienda a los estatutos se conforma a los requerimientos de “renuncia para postularse” de la ley del estado. Un voto de “sí” deberá tener el efecto de requerir que un miembro del concilio que desee postularse para el cargo de alcalde antes de que expire su término del mandato como miembro del concilio renuncie cuando registre documentos de nominación con el escribano de la ciudad.
