ORDINANCE 2988 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF GILBERT, MARICOPA COUNTY, ARIZONA, RELATING TO TAXATION LEVIED UPON PROPERTY WITHIN THE MUNICIPAL PARKWAY IMPROVEMENT DISTRICT NUMBERS 07-01, 07-02, 07-03, 07-04, 07-05, 07-06, 07-07, 07-08, 07-09, 07-10, AND 07-11 SUFFICIENT TO RAISE THE AMOUNT REQUIRED FOR PARKWAY IMPROVEMENTDISTRICTS FOR THE PERIOD JULY 1, 2026 TO JUNE 30, 2027; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR PENALTIES AND DECLARING AN EMERGENCY. WHEREAS, the provisions of A.R.S. Section 48-574 require the governing body to levy taxes upon all property in a municipal parkway improvement district necessary to pay the annual expenses of said districts; and WHEREAS, the Town Council of the Town of Gilbert posted budget notices for all addresses within the districts, and subsequently held a public hearing and adopted budget estimates for the expenses for the municipal parkway maintenance districts on May 5, 2026 WHEREAS, the Maricopa County Assessor’s Office requires the adopting of and reporting of levies prior to July 1, 2026; and WHEREAS, the County of Maricopa is the assessing and collecting authority for the Town of Gilbert, which requires the Town to transmit a certified copy of the Ordinance to Maricopa County; NOW THEREFORE, BE IT ORDAINED by the Common Council of the Town of Gilbert, Arizona, as follows: SECTION I As authorized by State law, the following annual amounts per lot are hereby levied for each district: PK 07-01 Val Vista Park $682.80/lot/yr. (28012) PK 07-02 Templeton Place $903.24/lot/yr. (28013) PK 07-03 Park Village $849.12/lot/yr. (28019) PK 07-04 Spring Meadows $620.76/lot/yr. (28016) PK 07-05 Circle G Meadows II $781.80/lot/yr. (28021) PK 07-06 Circle G Meadows III $829.20/lot/yr. (28020) PK 07-07 Circle G Ranches VI $1,544.52/lot/yr. (28014) PK 07-08 Circle G Ranches VII $697.68/lot/yr. (28022) PK 07-09 Morning Ridge $666.00/lot/yr. (28017) PK 07-10 Madera Parc $571.44/lot/yr. (28015) PK 07-11 Cassia Place $1,066.12/lot/yr. (28018) SECTION II Repeal of Conflicting Ordinances All ordinances or parts of ordinances in conflict with the provisions of this Ordinance or any part of the Code adopted herein by reference are hereby repealed. SECTION III Providing for Severability If any section, subsection, sentence, clause, phrase, or portion of this Ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decisions of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. SECTION IV Providing for Penalties Any person found guilty of violating any provision of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed two thousand five hundred dollars ($2,500) or by imprisonment for a period not to exceed six (6) months, or both such fine and imprisonment. Each day that a violation continues shall be a separate offense punishable as herein described.
