UNDER POWER
GEORGIA, RICHMOND COUNTY
By virtue of Power of Sale contained in a certain Deed to Secure Debt from DR Jade, LLC, hereinafter Grantor, to the Estate of Annie Burgess AKA Annie Elizabeth Burgess AKA Annie E. Burgess, dated April 1, 2025, recorded in Deed Book 1963, Page 1215, Richmond County Records (the “Security Deed”); there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in said county, within the legal hours of sale on the first Tuesday of August, to wit, August 4, 2026 the following described property:
All that lot or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, 1269th G.M.D., containing approximately one-half (½) acre, more or less, and fronting 100 feet, more or less, on the northwest side of Scott Nixon Memorial Drive (formerly, Pleasant Home Road Extension), running back between parallel lines a distance of 216.5 feet, more or less, as depicted on a plat of said property recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia in Realty Book 26-T, Page 119 and upon an individual plat of said property prepared for Annie E. Burgess by George L. Godman & Associates, George L. Godman, R.L.S., dated December 20, 1994, in Realty Reel # 481, Page 2184, reference being hereby made to said plats for a more complete and accurate description of the metes, bounds and location of said property

together with all fixtures and personal property attached to and constituting a part of said property, if any.
SAID PROPERTY IS KNOWN AS 815 SCOTT NIXON MEMORIAL DRIVE, AUGUSTA, GA 30907, please note that this address is provided for informational purposes only, the legal description controlling the correct description and location of the Property.
Said property will be sold “as is”, without any representation, warranty, or recourse against the above-named or the undersigned, subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, and assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above, and matters that may be revealed by a current survey or inspection of the property. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loan with the secured creditor. Pursuant to O.C.G.A. § 9-13-172.1 which allows for certain procedures regarding the recession of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above.
The debt secured by said Security Deed has been, and is hereby, declared due because of, among other possible events of default, nonpayment of the balance of said loan upon maturity of the Note. The debt remaining in default, the sale will be made for the purpose of paying said indebtedness and all expenses of sale as provided in said Security Deed, and the balance, if any, will be distributed as provided by law.
Pursuant to O.C.G.A. § 44-14-162.2, the following individual or entity shall have full authority to negotiate, amend, and modify all terms of the above-described security deed and associated notes on behalf of the secured creditor: Cardine Burgess as Executor of the Estate of Annie Burgess AKA Annie Elizabeth Burgess AKA Annie E. Burgess, Phone Number 706-373-8919. Please understand that such individual or entity is not required to negotiate, amend, or modify the terms of the Note or Security Deed.
To the best of the knowledge and belief of the undersigned, the party in possession of the property is DR Jade, LLC, tenants in possession, or persons claiming under it.
Said Property will be sold and deed under power executed by the undersigned to the purchaser.
