NOTICE OF PUBLIC AUCTION - FORECLOSURE SALE
OF COOPERATIVE APARTMENT
BY VIRTUE OF A DEFAULT in a certain Occupancy Agreement dated September 23, 2011, executed by DIANA G. ERDOS aka DIANA ERDOS, (the “Borrower”), and NEWREZ LLC D/B/A SHELLPOINT MORTGAGE SERVICING (the “Secured Party”), in accordance with its rights as holder of the security, the Secured Party, by Matthew D. Mannion, DCA# 1434494 and/or William Mannion, DCA# 796322 and/or John O’ Keefe, DCA# 2103965, Licensed Auctioneers of Mannion Auctions, LLC, will conduct a public auction sale of security consisting of (1) Two Hundred and Eighty-Seven (287) shares of Capital Stock of THORNNYCROFT TENANTS' CORP. (the “Corporation”), and (2) all right, title and interest in and to the Occupancy Agreement executed between said Secured Party and Borrower appurtenant to UNIT/APT 6H in the building located at and known as 209 GARTH ROAD, SCARSDALE, NY 10583, together with all fixtures and articles of personal property now or hereafter affixed to or used in connection with said apartment on August 6, 2026, 11:00 A.M. (New York Time),at the foreclosure alcove, located after security, in the first floor lobby of the Westchester County Courthouse, located at 111 Dr. Martin Luther King Jr. Blvd., White Plains, New York, in satisfaction of an indebtedness in the principal amount of $114,276.79 plus interest, late fees, attorney fees, maintenance in arrears and all other advanced charges. The sale is subject to the approval of the successful bidder by the Cooperative Corporation, its By-Laws, Rules and Regulations Apartment is to be sold “AS IS” and possession is to be obtained by the purchaser.
The Secured Party reserves the right to bid. The purchase price for the proprietary lease and the shares of capital stock of the Corporation shall be payable by certified or bank check, as follows: A ten (10%) percent deposit is required with a successful bid, payable to “Druckman Law Group, PLLC, as attorneys for Secured Party.” Cash will not be accepted, and the balance of the purchase price shall be payable at closing, within thirty (30) days of the aforementioned auction date.
