Notice of Public Hearing
PLEASE TAKE NOTICE that Seagull Holdings, LLC, (referred to as the "Applicant" in this notice) has applied to the Joint Land Use Board ("Board") of Hainesport Township for any and all variances, waivers, permits and/or approvals deemed necessary by the Board and/or the Applicant so as to permit the Applicant to install, repair, and/or refurbish, as necessary, three (3) internally illuminated freestanding signs, in accordance with the plans submitted. The property in question is located in the 38MHBP-Mount Holly By-Pass Redevelopment Area Zoning District (referred to as the "Zoning District" in this notice), and is presently occupied by Mount Holly Nissan. (The Zoning District contains an automobile dealership component, and the Automobile Dealership Component Zoning Standards, as well as the redevelopment plan are collectively referenced to in this notice as the "Zoning Standards").
By Resolution No. 2025-27, dated September 3, 2025, (the "Prior Resolution") the Board granted the
Applicant amended final site plan approval, as well as certain other variances, waivers, permits and/or approvals, including, but not limited to, for the three (3) freestanding pylon signs currently existing on the property, and for an additional monument sign to provide directional information.
Variances will be requested from Section VI.A.(11.ai) et. seq. of the Zoning Standards to allow the three (3) freestanding signs referenced in this notice:
Pylon sign No. 1 – the Applicant proposes to replace a 30 ft. high 132 square foot internally illuminated pylon sign with a 30 ft. high, 99.36 square ft. internally illuminated pylon sign. A pylon sign is proposed to replace the existing pylon sign, whereas monument style signs are required. A pylon sign of 18 feet in height and 125 square feet in area is permitted by the Zoning Standards. Pylon sign No. 1 also has a 5 ft. setback rather than the 15 ft. setback required under the Zoning Standards; however, the Prior Resolution allowed the existing Pylon Sign No. 1 to remain within the 15 foot setback area.
Pylon sign No. 2 – The Applicant proposes to replace/repair and/or refurbish as deemed necessary an existing "Nissan Pre-Owned Vehicles" pylon sign with a new sign panel and a new cabinet. If possible, the Applicant intends to utilized the existing support poles for Pylon Sign No. 2; Pylon sign No. 2 was approved in its present configuration and location under the Prior Resolution. Pylon Sign No. 2 currently has a sign area of 48 square feet, and is 21 feet in height. Pylon Sign No. 2 also has a 0.9 ft. setback rather than the 15 ft. setback required under the Zoning Standards; however, the Prior Resolution allowed the existing Pylon Sign No. 2 to remain within the 15 foot setback area. Proposed Pylon Sign No. 2 has a sign area of 45 square feet and is also 21 feet in height. A pylon sign of 18 feet in height and 125 sq. Ft. in area is permitted by the Zoning Standards.
Pylon sign No. 3 – Pylon sign No. 3 was permitted to remain in its current configuration and location in accordance with the Prior Resolution. Pylon sign No. 3 contains three separate sign panels as follows:
(a) A 72 square foot vinyl sign panel which is proposed to be refurbished with a polycarbonate sign panel. The existing internal illumination on that panel will be restored and/or replaced as necessary. No change in the first sign panel area of 72 square feet is proposed.
(b) A second vinyl sign panel on Pylon Sign No. 3 which is 144 square feet will be replaced with a polycarbonate sign panel, and the existing internally illumination will be restored and/or replaced as necessary. No change in the second sign panel area of 144 sq. ft. is proposed.
(c) A third sign panel on Pylon Sign No. 3, with an area of approximately 8 square feet, will be removed and will not be replaced.
(d) Pylon Sign No. 3 also has a setback of 6.4 ft. rather than the 15 ft. setback required under the Zoning Standards; however, the Prior Resolution allowed the existing Pylon Sign No. 3 to remain within the 15 foot setback area.
The Applicant also requests and seeks approval of any and all other variances that are identified to be required during the review and approval process.
The address of the property is 1513 Route 38, Hainesport, New Jersey 08036, and the property is designated on the official tax map of the Township of Hainesport as Block 42, Lot 2.04. The property is approximately 7.6 ± acres in size, and the present auto dealership building is approximately 10,278 ± square feet.
A public hearing for this application will be held on August 5, 2026 at 6:30 p.m. in the meeting room at the Hainesport Township Municipal Building, 1 Hainesport Centre, Hainesport, New Jersey, at which time you may appear either in person, by agent, or by attorney and present any objection which you may have to the granting of this application.
The public may inspect all documents relating to this application during normal business hours at the Office of the Secretary of the Board in the Township Municipal Building.
The Applicant sends this notice to you because the subject property is within 200' of the property owned by you or is otherwise required by law.
You are advised that the time and date of the hearing referred to in this notice may be changed, and you should verify the time and date of the hearing before attending.
Variances, waivers, permits and/or approvals, including but not limited to preliminary and final site plan approval, and/or use variances may be requested by the Applicant at the time of the hearing. The number, size, type, height, color, dimensions, size, proportions, message, location, setback and method of illumination of the signs being requested by the Applicant may be changed at the time of the hearing.
