One Norfolk Avenue, South Easton, MA 02375
By virtue and in execution of the Power of Sale contained in a certain mortgage given by One Norfolk Avenue Realty LLC (“Borrower”) to Baycoast Bank dated July 17, 2023 and recorded with the Bristol County North Registry of Deeds on July 18, 2023 in Book 28491 at Page 236, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 12:00 o’clock, p.m. on the 14th day of August, 2026, at One Norfolk Avenue, South Easton, MA 02375, all and singular the premises described in said mortgage,
To wit:
Parcel 1
A certain parcel of land situated on Norfolk Avenue in the Town of Easton, Bristol County, Massachusetts and shown as Lot A-2-C on a plan of land entitled “Plan of Land in Easton, Massachusetts, owned by Paramount Development Associates, Inc.” dated October 8, 1983, by Hayward-Boynton & Williams, Inc., which plan is recorded with the Bristol County North District Registry of Deeds in Plan Book 208, Page 6. Lot A-2-C is more particularly bounded and described, according to said plan, as follows:
Northeasterly by Norfolk Avenue, twenty and 00/100 (20.00) feet on a curve with a radius of fifty and 00/100 (50.00) feet;
Northeasterly, Northerly, Northwesterly, Westerly, Southwesterly and Southerly by Norfolk Avenue, four hundred twenty-four and 48/100 (424.48 feet on a curve with a radius of one hundred and 00/100 (100.00) feet;
Southwesterly by Lot A-2-B, two hundred fifty-four and 13/100 (254.13) feet;
Northwesterly by land now or formerly of Brockton Sand & Gravel Corp., four hundred ninety-one and 64/100 (491.64) feet;
Northeasterly by land now or formerly of Brockton Sand & Gravel Corp., five hundred fifty-four and 35/100 (554.35) feet;
Northwesterly by land now or formerly of Brockton Sand & Gravel Corp., two hundred ninety-nine and 05/100 (299.05) feet;
Northeasterly by land now or formerly of Brockton Sand & Gravel Corp., five hundred seventy-eight and 63/100 (578.63) feet;
Southeasterly by land of Orlando DiMascio, five hundred and 00/100 (500.00) feet;
Southwesterly by Lot B-4-3, one hundred twenty-one and 06/100 (121.06) feet;
Southeasterly by Lot B-4-5, one hundred ninety-nine and 62/100 (199.62) feet; and
Southwesterly by Lot B-4-A and Lot A-2-P, five hundred eighty-eight and 44/100 (588.44) feet.
Parcel 2
The land, together with the buildings and improvements thereon, in the Town of Easton, Bristol County, Massachusetts, being shown on plan of land entitled “Plan of Land in Easton, Ma., surveyed for Pharmasol Corporation” dated June 12, 1984, scale 1"=30', prepared by Arthur C. Thompson, Inc., and recorded with the Bristol County (ND) Registry of Deeds in Plan Book 213, Page 41, being more particularly bounded and described according to said plan as follows:
Southeasterly by land of Pharmasol Corporation, eighty and 06/100 (80.06) feet, more or less;
Southwesterly and Westerly by other land of Pharmasol Corporation, five hundred fifty-four and 35/100 (554.35) feet;
Northwesterly by land of Plantation Realty Trust, fifty-six and 40/100 (56.40) feet, more or less: and
Northeasterly, Easterly and Southeasterly by a line two feet Easterly of and parallel to a line marked “Edge of Pond located May 11, 1994” on said plan, six hundred seven (607.00) feet, more or less.
Being the same premises conveyed to One Norfolk Avenue Realty LLC by deed of Pharmasol Corporation, a Delaware corporation, dated September 19, 2008 and recorded with the Bristol County North Registry of Deeds in Book 17685, Page 315.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assignments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens, and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not refence to such restrictions, easements, improvements, liens, or encumbrances is made in the deed.
The premises are also sold subject to the right of redemption of the United States of America.
Terms of Sale:
1. Successful bidder must furnish a deposit in the amount of TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) in cash or certified bank check at the time and place of sale;
2. Remaining balance to be paid at closing;
3. Closing to occur on or before the 30th day after sale;
4. Subject to all encumbrances, prior liens and such matters which may constitute valid liens or encumbrances after sale;
5. Foreclosure deed to be delivered to purchaser for recording upon full receipt of the purchase price;
6. Description of the premises set forth in the mortgage controls in the event of any error in the Notice of Sale;
7. Purchaser responsible for all closing costs, recording costs, deed stamps, accrued or past due property taxes, etc.;
8. In the event of default by highest bidder, second highest bidder may purchase provided deposit is paid within five (5) days of notice, otherwise a new auction sale will be conducted;
