26074SS4 FORM 6 Department of Human Services Notice of Public Hearing to Adopt Rules A public hearing will be held in the Seasons Conference Room of the Hillsview Building, 3800 E Hwy 34, Pierre, SD 57501, on Wednesday, August 19th, 2026, at 1pm (Central) / Noon (Mountain), to consider the amendment of proposed Administrative Rules of South Dakota numbered § 46:11:03:02, 46:11:03:10, 46:11:04:02, 46:11:04:07, 46:11:06:15, 46:11:08:01, 46:11:09:05, and 46:17:04:10. The effect of the rules will be to standardize and clarify critical incident reporting requirements; make restoration plans dependent on ISP progress, rather than time limited; allow providers an additional month to file cost reports and audits; standardize insurance requirements; provide a standardized format to assist in participant safety monitoring data analysis; update the CHOICES waiver services to match the federally approved waiver; and avoid conflict and redundancy with federal requirements, while requiring opportunity for discussion of all medications with clients at the South Dakota Developmental Center. The reason for adopting the proposed rules is to provide improved person-centered services to individuals, to reduce administrative burden on providers, and to comply with federal waiver and regulations.
