WIGGIN, of York, Maine, PLAINTIFF vs. ALBERT TRANQUILLINO, formerly of Boston, Massachusetts, individually and as Trustee of the Regent Realty Trust, HENRY MUOLLO, formerly of Boston, individually and as Trustee of the Regent Realty Trust and ALBERT TRANQUILLINO, JR. of Wrentham Massachusetts, and their heirs, legal representatives, devisees, assigns, trustees in bankruptcy, disseisors, creditors, lienors, and grantees and any and all other persons unascertained or not in being or unknown or out of the State, and all other persons whomsoever may claim any right, title, interest, or estate, legal or equitable in the hereinafter described land and real estate through any of said Defendants, DEFENDANTS.
AMENDED ORDER ON MOTION FOR SERVICE BY ALTERNATE MEANS (Title to Real Estate Involved).
The Court hereby GRANTS Plaintiff's Motion to Modify the Court's Order on Motion for Service by Alternate Means Pursuant to M.R. Civ. P. 4(g), and enters this AMENDED Order on Motion for Service by Alternate Means:
This cause came on for hearing upon the Motion of Plaintiff's attorneys, Woodman Edmands, whose office address is 234 Main Street, Biddeford, Maine 04005, for service by publication upon the Defendants named above pursuant to Maine Rule of Civil Procedure 4 (g), except for Albert Tranquillino, Jr. who can be served pursuant to Rules of Civil Procedure 4(f)), and it appearing that Plaintiff's Complaint seeks to confirm Plaintiff's title to the real property described in the York County Registry of Deeds, Book 7737, Pages 122-123 and further described below. The Court finds that the Plaintiff has met the requirements contained in Maine Rule of Civil Procedure 4(g)(1)(A)-(C).
It appearing that the said DEFENDANTS to be served by publication cannot with due diligence be served by any other method since their precise identities and addresses are not known and cannot be ascertained by reasonable diligence; and
It is further agreed that this Complaint seeks: (1) to quiet title to said real estate pursuant to 14 M.R.S. Section 6651, et seq.; (2) reformation of the deed granting Plaintiff title to the real property described in York County Registry of Deeds, Book 7737, Pages 122-123 and further described below; and (3) a judicial declaration establishing and confirming PLAINTIFF'S title to the subject property as against all the DEFENDANTS named or described in the said Complaint, and that said DEFENDANTS' claim to the subject property is barred.

Wiggin, has begun a lawsuit against you in the York County Superior Court, which holds sessions at the Maine Judicial Center at 515 Elm Street in the City of Biddeford, County of York, Maine. If you wish to oppose this lawsuit, you or your attorney MUST PREPARE AND SERVE A WRITTEN ANSWER to the Complaint which may be obtained from the Court WITHIN TWENTY (20) DAYS of last publication of this Notice as set forth below. You or your attorneys must serve your Answer by delivering a copy of it in person, by mail, or by email to the Plaintiff's attorney, whose name and address, including email address appear below, or by delivering a copy of it in person or by mail to the Plaintiff, if the Plaintiff's name and address appear below. You or your attorney must also file the original of your Answer with the court by mailing it to: Clerk of Superior Court, 515 Elm Street, Biddeford, ME 04005, before, or within a reasonable time after, it is served. A copy of said Answer shall also be filed with this Court. It is further ordered that this Order be published in the York County Coast Star, a weekly newspaper published in York County, Maine, once per week for three successive weeks. Since no address of the DEFENDANTS is known, a copy of such notice need not be mailed. The date of the first publication shall be within (20) days of the date hereof. Property Description: A certain parcel of land situated on the southerly side of Mountain Road in the Town of York, County of York, and State of Maine bounded and described as follows: Beginning at an iron pipe on the southerly sideline of Mountain Road, being the northeast corner of herein described parcel: thence, South 12° – 27'-39" West by land formerly of Nelson Saulnier for a distance of 181.47 feet to land now or formerly of John and Cary A. Lydtson; thence, North 50° – 55'-44" West by said Lydston land for a distance of 101.00 feet to the southeasterly sideline of a private right-of-way; thence, North 31° - 31'-07" East along said right-of-way for a distance of 159.18 feet to Mountain Road; thence, South 57° - 10'-52" East along the southerly sideline of Mountain Road for a distance of 40.88 feet to the point of beginning. Containing 11,446 square feet, more or less, in area.
