NOTICE OF HEARING
TO WHOM IT MAY CONCERN:
In compliance with the pertinent provisions of the Township of Berlin Zoning and Land Development Ordinance, and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that a written application has been filed by the undersigned Applicant with the Township of Berlin Planning and Zoning Board for "d" variance relief pursuant to N.J.S.A. 40:55D-70(d)(1), preliminary and final major site plan approval and "c" variance relief pursuant to N.J.S.A. 40:55D-70(c) for rear yard and side yard setbacks from the municipal boundary line that intersects the site, minimum signage height above the ground, the number of wall signs, wall signage area, accessory structure height and accessory structure area, together with any and all other variances or waivers the Board may reasonably require in the exercise of its discretion and without further public notice, in order to permit the undersigned Applicant to construct, establish and maintain a 5,915 s.f. Wawa convenience store with gasoline fueling facilities, including fifty-five (55) parking spaces and other related and associated site improvements, including but not necessarily limited to stormwater management, site lighting, signage and landscaping. The Wawa retail convenience store is a permitted use in the Highway Commercial ("C-2") Zone pursuant to Township Code Section 340-51A. The gasoline fueling component is a conditionally permitted use in the C-2 Zone as a form of automobile servicing pursuant to Township Code Section 340-53A.(1), however, because no conditional use standards exist for the undersigned Applicant to comply with, "d(1)" variance relief is required in accordance with Meszaros v. Planning Board, 371 N.J. Super. 134, 149-150 (App. Div. 2004).
The proposed development pertains to the property shown as Lots 12 and 13 in Block 1002 on the Township of Berlin Tax Map, which property is located at 599 Route 73 North in the Township of Berlin, Camden County, New Jersey. The property is intersected by the municipal boundary between Berlin Township and Voorhees Township, resulting in a portion of the development affecting Block 303, Lots 5 & 8 in Voorhees Township, otherwise known as 67 Cooper Road and 69 Route 73, respectively. A separate application was filed with the Voorhees Township Planning Board and a separate public hearing already was conducted before the Voorhees Township Planning Board.
Public hearing before the Berlin Township Planning and Zoning Board on the above-mentioned application filed in Berlin Township has been scheduled for December 16, 2025, at 5:30 P.M. in the Township of Berlin Municipal Building, 135 Route 73 South, West Berlin, NJ 08091, at which time and place any interested party (as defined in N.J.S.A. 40:55D-4) will have an opportunity to be heard.
All documents relating to this application may be inspected by the public during regular business hours in the Office of the Land Use Secretary located at the Township of Berlin Municipal Building, 135 Route 73 South, West Berlin, NJ 08091. Please take further notice that the Board may, in its discretion, adjourn, postpone or continue said hearing from time to time and you are hereby notified that you should make diligent inquiry of the Office of the Land Use Secretary concerning such adjournments, postponements or continuations.
