SUPERIOR COURT DEPARTMENT
PLYMOUTH, ss Case No. 2683CV00329
JEFFREY BAGLEY, et al.
v.
CHRISTY'S OF CAPE COD, LLC, et al.
ORDER OF NOTICE BY PUBLICATION
TO: Christy's of Cape Cod, LLC, its successors and assigns, and Aurora Loan Services, Inc., its successors and assigns.
You are hereby notified that a civil action has been filed by the above-named plaintiff in which you are named as a defendant, wherein they are seeking alternative service of process by publication. This action concerns a property known and numbered as 62 High Street, Wareham, MA 02571 (the "Property"). Said Property is described in the deed recorded with the Plymouth County Registry of Deeds in Book 16266, Page 101.
Plaintiff filed the complaint seeking a declaratory judgment concerning title to the Property. Specifically, the Plaintiff seeks to quiet title to 62 High Street, Wareham, MA, and obtain a declaratory order that the mortgages held by the above-named parties have been discharged. Said mortgages are recorded with the Registry in Book 16266, Page 102 and Book 29433 Page 240. This will have the effect of removing the cloud on title that currently exists due to the lack of effective discharges.
This complaint may be examined at the Plymouth County Superior Court, or a copy obtained from plaintiff's attorney.
If you intend to make any defense, you are hereby required to serve upon the plaintiff's attorney, Shannon F. Slaughter, Esq., Dalton & Finegold, LLP, whose address is 34 Essex Street, Andover, MA 01810 an answer to the complaint on or before the 10th day of July, 2026, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day.
If you fail to do so, judgment by default will be taken against you for relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or occurrence that is the subject matter of the plaintiffs' claim, or you will thereafter be barred from making such claim in any other action.
It appearing to this Court that no personal service of the Complaint has been made on the defendants identified herein above that after diligent search Plaintiffs can find no such persons upon whom they can lawfully make service, it is ORDERED that notice of this suit be given to them by publishing a copy of this notice once in (1) the Wareham Week, a newspaper of general circulation in Wareham, MA, where the Property is located, (2) the Barnstable Patriot, a newspaper of general circulation in Hyannis, MA, where the last known address of Christy's of Cape Cod, LLC was located, and (3) the Scottsbluff Star-Herald, a newspaper of general circulation in Scottsbluff, NE, where Aurora Loan Services, Inc. was last headquartered, once a week for three (3) successive weeks, the last publication to be at least 20 days before the above responsive pleading due date.
Dated at Plymouth, Massachusetts, this 12th day of May, 2026.
Hon. Sharon Donatelle, Justice
