NEW JERSEY DEPARTMENT OF TRANSPORTATION – EMERGENCY ROUTE 46 MP 5.5 EMBANKMENT WASHOUT Take notice that an application for a Freshwater Wetlands Individual Permit and Flood Hazard Area Individual Permit has been submitted to the New Jersey Department of Environmental Protection, Division of Land Resource Protection for the development described below: The New Jersey Department of Transportation (NJDOT) requested and received emergency authorization (2113-23-0001.1 FHA230001 & FWW 230001) to repair the breached berm of Beaver Brook Tributary that caused a landslide along Route 46 MP 5.5 in Knowlton Township and White Township, Warren County, New Jersey. The emergency authorization project included the repair of the breached berm causing water flowing down Route 46, reestablishing the stream bed, and cleaning up debris and other deposited material on Route 46. Due to the completed work being within the regulated state open waters and wetlands, the NJDOT is required to submit New Jersey Department of Environmental Protection (NJDEP) permit applications to the NJDEP. Hardship Exception: The completed project includes a hardship exception request for N.J.A.C. 7:13-11.3 and N.J.A.C. 7:13-12.12 due to the placement of fill in a floodway to construct the emergency berm. No flood-related adverse impacts will be created due to the construction of the emergency berm and no adjacent properties will be impacted. The complete permit application package can be reviewed at the municipal clerk's office in the municipality in which the site subject to the application is located (White Township or Knowlton Township) or by appointment at the Department's Trenton Office.
