NOTICE OF ACTIVITY AND USE LIMITATION 330 WEST BAY ROAD OSTERVILLE, MASSACHUSETTS RTN 4-29459 A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, § 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On December 5, 2025, GN Realty LLC recorded with the Barnstable County Registry of Deeds a Notice of Activity and Use Limitation on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The Notice of Activity and Use Limitation will limit the following site activities and uses on the above property: 1. Any building constructed within the Portion of the Property subject to the AUL, must either include design measures approved by an LSP to control potential vapor migration, or have an evaluation conducted by an LSP who renders an Opinion that design measures to control potential vapor migration are not required; 2. Other than during emergency utility repair, a NAPL Management Plan and Health and Safety Plan must be prepared and implemented prior to the excavation of soil within the Portion of the Property subject to the AUL; and 3. Any vapor mitigation measure installed within the Portion of the Property subject to the AUL, as described in No. 1 above, must be monitored, inspected, and maintained in accordance with the recommendations of an LSP.
