NOTICE OF DECISION
Borough of Fairview Zoning Board of Adjustment
PLEASE TAKE NOTICE that on December 11, 2025, the Borough of Fairview Zoning Board of Adjustment (the "Board") adopted a resolution (the "Resolution") memorializing its decision granting the application of Paul Juliano (the "Applicant") for preliminary and final major site plan approval along with use variance, bulk variance and design waiver/exception relief with respect to property having a street address of 28 Grant Street, Fairview, New Jersey and being designated as Block 219, Lot 17, on the Borough of Fairview Tax Map (the "Property").
The Board approved the Applicant's application to raze the existing site improvements and to construct a new three- (3) story, multi-family dwelling structure including four (4) dwelling units, on the Property, along with ancillary site improvements, including, but not limited to, landscaping and lighting infrastructure.
The Board granted the Applicant use variance relief pursuant to N.J.S.A. 40:55D-70(d)(1) for the development of a multi-family dwelling where same is not permitted. The Board also granted the Applicant use variance relief pursuant to N.J.S.A. 40:55D-70(d)(4) for floor area ratio ("FAR") greater than permitted (0.76 FAR permitted; 1.026 FAR approved). The Board also granted the Applicant use variance relief pursuant to N.J.S.A. 40:55D-70(d)(5) for lot area per dwelling unit less than required (2,500 sq.ft. per dwelling unit required; 1,252.25 sq.ft. per dwelling unit approved).
The Board also granted the Applicant certain bulk or "c" variances and design waivers/exceptions in connection with its approval of the Application, including: (1) Building coverage greater than permitted (40% permitted; 49.08% approved); (2) Impervious coverage greater than permitted (65% permitted; 71.92% approved); (3) Projection of steps into the front yard and side yard greater than permitted (4 ft. in front yard or side yard permitted; 14 ft. & 15 ft. in the front yard approved; 4 ft. 2 in. in the left side yard approved; and 4 ft. 4 in. in the right side yard approved); (4) Side yard setback less than required (5 ft. (one) and 10 ft. (total) required; 3.33 ft. (one) and 7.83 ft. (total) approved); and (5) Building height greater than permitted (30 ft. and 2.5 stories permitted; 31 ft. and 3 stories approved).
The Resolution has been filed with and is available for public inspection at the Office of the Borough Clerk which is located in the Borough of Fairview Municipal Building, 59 Anderson Avenue, Fairview, New Jersey 07022, during regular business hours, which are typically Monday through Friday between the hours of 8:00 am to 4:00 pm.
