NOTICE OF DECISION
Township of Wayne Planning Board
PLEASE TAKE NOTICE that on October 14, 2025, the Township of Wayne Planning Board (the "Board") adopted a resolution (the "Resolution") memorializing its decision granting the application of Bolla Oil Corporation (the "Applicant") for preliminary and final major site plan approval with ancillary bulk variance and design waiver/exception relief with respect to property in the Township of Wayne having a street address of 1440 Route 23, Wayne, New Jersey 07470 and being designated as Block 1401, Lot 12 on the Township of Wayne Tax Map (the "Property").
The Board approved the Applicant's application to demolish the existing one-story building on the Property and to construct an approximately 2,357 sf convenience store/retail food establishment and an automobile service station consisting of six (6) fuel dispenser pumps (with 12 fueling positions) and fuel station canopy along with related site improvements, including, but not limited to, grading, drainage, utilities, lighting, signage, landscaping, retaining wall and parking infrastructure (the "Application").
The Board also granted certain bulk or "c" variance and design waiver/exception relief in connection with its approval of the Application, including: (i) Accessory structure (fuel canopy) approved within the NJ Route 23 front yard where the same is not permitted; (ii) Accessory structure (fuel canopy) approved within the Packanack Lake Road front yard where the same is not permitted; (iii) Building height for accessory structure greater than permitted (15 ft. permitted; 20 ft. (fuel canopy) approved); (iv) Fuel canopy sign approved to extend above the structure of the canopy where the same is not permitted; (v) Pedestrian walkway access from NJ Route 23 not provided where the same is required; (vi) Parking area setback from building wall/façade less than required (10 ft. required; 6 ft. approved); (vii) Parking area buffer less than required (10 ft. required; 8.2 ft. approved); (viii) Curbs within parking areas made of concrete curbing where same is not permitted; (ix) Existing driveways within 100 ft. of NJ Route 23 & Packanack Lake Road (62.2 feet and 78.3 feet) approved to remain where the same is not permitted; (x) Distance between driveways connecting NJ Route 23 less than required (200 ft. required; 34.5 ft. existing and approved); (xi) Driveway width for one-way commercial driveways greater than permitted (24 ft. permitted; 30 ft. and 35 ft. existing and approved); (xii) Barrier-free sidewalk approved not to be provided where same is required; (xiii) Parking lot lighting intensity greater than permitted (0.5 to 1.0 lumens per foot permitted; 19.1 lumens per foot (parking area) and 27.5 lumens per foot (fuel canopy) approved; (xiv) Lighting intensity at property line greater than permitted (0.1 lumens per foot permitted; 0.8 lumens per foot approved); (xv) Shade tree spacing greater than permitted (60 ft. required; 70 ft. along Packanack Lake Road and 123 ft. along NJ Route 23 approved); (xvi) Shade tree distance from curb approved not to comply (14 ft. from the face of the curb required; 24 ft. along NJ Route 23 and 10 ft. along Packanack Lake Road approved); (xvii) Electric utility approved to be placed overhead where underground utilities are required; (xviii) Four (4) Arborvitae replacement trees approved where same are not permitted species; (xix) Maximum area of site disturbance greater than permitted (32,945 sf permitted; Total Adjusted Disturbed Area of 38,210 sf approved); and (xx) Loading area approved not to be provided where same is required.
The Resolution has been filed with and is available for public inspection at the office of the Board, which is located in the Office of the Planning Department, 475 Valley Road, Wayne, New Jersey 07470, during regular business hours, which are typically Monday, Wednesday, Thursday and Friday (8:30 am to 4:30 pm); and Tuesdays between 8:30 am to 7:00 pm.
