NOTICE OF FORFEITURE OF OIL AND GAS LEASE OHIO REVISED CODE 5301.332 TO: Huffman Drilling Co and Huffman Bowers Inc. or their successors and assigns, whose last known address is P.O. Box 538, 450 South State Street, New Lexington, Ohio 43764 AND Harry Plummer, or their successors and assigns, whose last known address is Route 1, Carroll, Ohio: Please be advised that Braun Holdings Pickerington, LLC ("Current Owner") is the current lessor under that certain Oil and Gas Lease recorded with the Fairfield County Recorder's Office on December 6, 1963, in Lease Vol. 52, Page 294 with a lease term of five (5) years from Lease date, and as long thereafter as oil or gas, or either of them, is produced from said land by the lessee; and that certain Oil and Gas Lease recorded with the Fairfield County Recorder's Office on December 6, 1963, in Lease Vol. 52, Page 310 with a lease term of five (5) years from Lease date, and as long thereafter as oil or gas, or either of them, is produced from said land by the lessee (collectively, the "Oil and Gas Lease"). The Oil and Gas lease encumbers, among other property, that certain real property located Pickerington Road Northwest, Pickerington, Ohio 43147, further identified as Parcel Numbers 0360024070, 0360024080, 0411259500, 0411266110 in the Office of the Fairfield County Auditor (the "Property"), as more particularly described in that certain General Warranty Deed recorded with the Fairfield County Recorder's Office in Instrument No. 202400016978. Since the Current Owners acquired the Property, the Current Owners have received no rent or royalty payments in connection with the Oil and Gas Lease and has no knowledge of any producing oil or gas wells located on the Property. Stating further, the term of the Oil and Gas Lease has expired. This serves as formal notice that after thirty (30) days and not more than sixty (60) days from the publication of this notice, the Current Owners intend to record an Affidavit of Forfeiture pursuant to Ohio Revised Code 5301.332 with the Fairfield County Recorder's Office declaring the termination of the Oil and Gas Lease, solely with respect to the Property, if the Oil and Gas Lease is not released within thirty (30) days from the publication of this notice. After such time, the encumbrance of the Oil and Gas Lease on the Property shall be of no further force and effect nor shall the rights of the owner of the Property be affected by or subject to the rights of any party to the Oil and Gas Lease.
