NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Jennifer R. Cass to Mortgage Electronic Registration Systems acting solely as nominee for America's Wholesale Lender dated July 22, 2005, recorded at the Worcester County (Worcester District) Registry of Deeds in Book 36900, Page 128; said mortgage was then assigned to The Bank of New York Mellon f/k/a The Bank of New York, as Trustee for the Certificateholders CWABS, Inc., Asset Backed Certificates, Series 2005-11 by virtue of an assignment dated March 23, 2009, and recorded in Book 43996, Page 38; of which mortgage the undersigned is the present holder for breach of conditions of said mortgage and for the purpose of foreclosing the same will be sold at PUBLIC AUCTION at 12:30 PM on December 18, 2025, on the mortgaged premises. This property has the address of 10 Arbutus Road, Worcester, MA 01606. The entire mortgaged premises, all and singular, the premises as described in said mortgage:
The land with the buildings thereon known and numbered as 10 Arbutus Road, Worcester, Worcester County, Commonwealth of Massachusetts will all the buildings thereon and with all the privileges and appurtenances belonging thereto situated on the southerly side of Arbutus Road in said City of Worcester and bounded and described as follows;
BEGINNING at a point in the said southerly line of Arbutus Road which is distant two hundred nine and two hundredths (209.02) feet from the intersection of the southerly line of Arbutus Road with the easterly line of Burncoat Street;
THENCE running southerly by lot numbered 49 on a plan hereinafter described, one hundred eleven (111) feet to a point at land on one O'Connell now or formerly;
THENCE turning and running easterly by said O'Connell land sixty (60) feet to a point at lot numbered 47 on said plan;
THENCE turning and running northerly by said lot numbered 47 one hundred ten and seventy-five hundredths (110.75) feet to a point in said southerly line of Arbutus Road;
THENCE turning and running westerly by said line of arbutus Road sixty (60) feet to the point of beginning.
Being lot numbered 48 on a plan of lots for the Stevens Estate made by C.M. Allen, C.E., dated January 1926 and recorded with the Worcester District Registry of Deeds in Plan Book 46, Plan 39.
Being the same premises conveyed to the herein named mortgagor (s) by deed recorded with Worcester District Registry of Deeds in Book 33465, Page 88.
Subject to and with the benefit of easements, reservation, restrictions, and taking of record, if any, insofar as the same are now in force and applicable. In the event of any typographical error set forth herein in the legal description of the premises, the description as set forth and contained in the mortgage shall control by reference. Together with all the improvements now or hereafter erected on the property and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock and all fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this sale.
Terms of Sale: Said premises will be sold subject to any and all unpaid taxes and assessments, tax sales, tax titles and other municipal liens and water or sewer liens and State or County transfer fees, if any there are, and TEN THOUSAND DOLLARS ($10,000.00) in cashier's or certified check will be required to be paid by the purchaser at the time and place of the sale as a deposit and the balance in cashier's or certified check will be due in thirty (30) days, at the offices of Doonan, Graves & Longoria, LLC ("DG&L"), time being of the essence.
