NOTICE OF PUBLIC HEARING REGARDING PROPOSED CONSTRUCTION OF FINGER LAKES COMMUNITY COLLEGE CULINARY ARTS CENTER OF EXCELLENCE
NOTICE IS HEREBY GIVEN that a public hearing will be held before the Board of Supervisors of Ontario County on May 21, 2026, at 6:30 PM in the Board of Supervisors Sessions Room on the 2nd Floor of 74 Ontario Street, Canandaigua, New York, 14424, to solicit public input regarding the environmental review and determination of significance under the New York State Environmental Quality Review Act of the proposed construction and operation of the Finger Lakes Community College (FLCC) Culinary Arts Center of Excellence (CACE) as well as the exemption of said project from the City of Canandaigua's Zoning.
The CACE involves the construction of an approximately 19,287-square-foot facility on 2.519 acres of land to be subdivided from of the remaining property of the Canandaigua Area Development Corporation located at approximately 150 Lakeshore Drive immediately west of the existing Speedway Gas Station and across the street from Kershaw Park in the City of Canandaigua. Operationally, the CACE will serve as the home for FLCC's Culinary Program, house the New York State Wine and Culinary Center (doing business as New York Kitchen, or 'NYK') offices, an office for Cornell Cooperative Extension of Ontario County, and shared demonstration space and kitchen teaching space. NYK will operate retail and tasting space for New York State sourced food and beverages but will not operate a restaurant. The site is a known brownfield for which a remediation and management plan has been developed and approved by the New York State Department of Environmental Conservation and has already been implemented. Approval of the subdivision of property from the City of Canandaigua Planning Commission and approval of the relocation of sewer and pedestrian easements, modification of a public parking lot, and entry drive modifications on both Muar St. and Lakeshore Dr. by the City of Canandaigua Common Council are also required independent of any exemption from the City of Canandaigua's zoning.
The Board of Supervisors will also consider whether the project will be exempt from the City of Canandaigua's zoning law pursuant to New York State's "Balancing of Public Interests Test" involving evaluating: 1. the nature and scope of the instrumentality seeking immunity, 2. the County's legislative grant of authority, 3. the kind of function or land use involved, 4. the effect local land use regulation would have upon the enterprise concerned, 5. alternative locations for the facility in less restrictive zoning areas, 6. the impact upon legitimate local interests, 7. alternative methods of providing the proposed improvement; 8. the extent of the public interest to be served by the improvements, and 9. intergovernmental participation in the project development process and an opportunity to be heard.
All persons wishing to appear and be heard at the hearing to comment on the proposed project, the environmental review thereof, and/or the consideration of the project's exemption from zoning once the property is owned and held in trust by the County of Ontario for the educational purposes of Finger Lakes Community College, may do so in person or by attorney or other representative. Written comments may be submitted until 5:00 PM on May 20, 2026, to the Office of the Clerk of the Board of Supervisors, or may be submitted at the hearing itself.
