NOTICE OF PUBLIC SALE OF CO-OP UNIT
BY VIRTUE OF A DEFAULT under that certain Credit Agreement, Security Agreement, and Promissory Note, dated June 9, 2006, and made by Angelina Targon and Anna Afanasyeva ("Debtor") and in favor of America's Wholesale Lender. ("Secured Party"), in the original amount of $88,000.00, lent at an annual rate of 7.375% initially, for a period of not more than thirty (30) years.
NOTICE IS HEREBY GIVEN that pursuant to the Uniform Commercial Code as adopted in New Jersey, N.J.S.A. 12A:9-610 (2013), that the Secured Party, by William Mannion, Licensed Auctioneer DCA # 796322, and/or Matthew D. Mannion, Licensed Auctioneer DCA # 1434494, will sell the collateral hereinafter described at public auction on December 22, 2025, at 10:30 A.M. Eastern Time at the offices of Professional Appearances, 407 Essex St., Millburn, NJ 07041, at which time the following collateral will be sold:
All share certificates, leases, stock powers, assignments of leases, and other agreements, instruments, and documents, pursuant to which certain rights or benefits have been granted to the Debtor, all in connection with or pursuant to certain Promissory Notes and Security Agreements (collectively, the "Collateral") representing Debtor's interest in property: 900 shares of capital stock of 1170 Apartment Corp ("Corporation") together with any substitute, replacement, or additional shares of the Corporation issued and allocated to UNIT #2B in the building known as 400 FAIRVIEW AVENUE, UNIT #2B, FORT LEE, NJ 07024, together with any interest in the common elements purchased in connection with said Unit and all of the corresponding right, title, and interest in that certain proprietary lease dated between Angelina Targon and Anna Afanasyeva and America's Wholesale Lender.
The aforesaid share of stock and proprietary lease entitles the owner to possession of a cooperative unit subject to the terms of the aforesaid proprietary lease, and substitutes, replacement or extensions of the lease, articles of incorporation and bylaws including, but not limited to the admissions application for prospective buyers, drafted and reviewed by America's Wholesale Lender. Any buyer must be approved and admitted by the Corporation. Application is available through Secured Creditor Counsel or through America's Wholesale Lender's successor Select Portfolio Servicing, Inc.
The underlying indebtedness, in the approximate amount of $65,285.60, plus any other additional costs represented by the Promissory Note, including but not limited to legal fees, costs of sale, or maintenance fees, or as represented by any other form of repayment agreement between the Debtor and the Secured Party is not part of this auction and is not being sold. The collateral may be redeemed by the Debtor up to the date of the sale by payment of all amounts due in certified funds to Secured Party Counsel.
The purchase price for the collateral shall be the highest bid. The purchase price for the Collateral shall be payable in cash or by certified or bank check, of which a ten (10%) percent deposit is required with the successful bid at the time of auction and the balance of the purchase price shall be payable within thirty (30) days ("Closing Date"). The Secured Party reserves the right to bid at this sale, shall not be required to post a deposit with the Auctioneer, and may credit against the
purchase price bid all sums due to the Secured Party under the Security Agreement. Should the successful bidder fail to deliver the balance of the purchase price within the time period, the collateral may be resold and any loss arising from such resale will be the responsibility of the former successful bidder. The sale may be subject to further conditions and revisions as may be announced at the start of the auction. The Collateral may be inspected upon advance request to Secured Party Counsel and at Secured Party Counsel's offices: Kathleen M. The Co-Op Unit will be sold as is, subject to superior liens, if any, subject to rights of tenants or occupants in possession, if any, and subject to rights of the cooperative corporation.
