Pursuant to a judgment of foreclosure and order of sale in the above-entitled action, dated January 2, 2025 and entered on January 9, 2025, I, the undersigned, the Referee of said judgment named, will sell at public auction at the Broome County Court House (basement level - inside lobby) in the City of Binghamton, County of Broome and State of New York on December 17, 2025 at 10:00 a.m., subject to covenants and restriction and easements of record, subject to violations, zoning regulations and ordinances of the city, town, village or county in which the premises lie, subject to existing leases, tenancies and occupancies, subject to all real property taxes, assessments, water and pollution control charges, subject to the liens of any prior judgments, mortgages or other encumbrances of record, subject to the right of redemption of the United States of America, if any, and subject to such state of facts that an accurate survey may disclose, the mortgaged premises directed in and by said judgment to be sold, commonly known as 7 Edson Road, Windsor, NY 13865 and described as follows:
PARCEL No. 1:
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Windsor, Broome County, New York, bounded and described as follows: Beginning at a point in the center of the highway leading from Windsor to Locust Hill at the northeast corner of premises (now or formerly) of Berton S. Stannard and wife (formerly Adna R. Barton); thence north 36 degrees 20 minutes east along the center of said highway 13 chains 58 links to the northeast corner of premises hereby conveyed; thence south 10 ½ degrees east 15 chains 37 links to a stake and stones set in the northerly line of premises also (now or formerly) of said Stannard thence north 84 degrees west 9 chains 21 links to a square stone set in the southwesterly corner of premises (now or formerly) of the Bartonville Grange No. 589; thence north 37 degrees west 3 chains 69 links to the center of said highway and the point or place of beginning, containing 6.72 acres of land, be the same more or less.
EXCEPTING AND RESERVING therefrom all the right, title and interest in and to the premises heretofore conveyed by Mary Sutliff to J. J, Henry et al. for use of the Methodist Episcopal Church of Edson by deed dated December 15, 1900, and recorded in said Clerk's Office January 14, 1902 in Book 184 of Deeds at page 504 and thereafter conveyed to the Bartonville Grange No. 589 by the heirs of Mary Sutliff Spoor by deed dated August 25, 1939 and recorded in said Clerk's Office November 8, 1939 in Book 491 of Deeds at page 404 and by Charles W. Andrews and wife by deed dated August 24, 1939 and recorded in said Clerk's office November 8, 1939 in Book 491 of Deeds at page 405, being a lot 50 x 135 feet lying on north side of Edson-South Windsor Hwy on east line thereof.
PARCEL No. 2:
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Windsor, County of Broome and State of New York, bounded and described as follows : Being 100 acres, more or less, off the west side of Lot No. 3, (now or former) Carpenters 1050 acre Sherwood Tract and described in a survey of said parcel made by H. S. Williams, surveyor, dated April 19, 1912 as follows: Beginning at the southwest corner of said Lot No. 3; thence north 10 degrees east 40 chains to a stake and stones, (now or former) Reuben Sherwood lands (now or former Gerald H. Colwell); thence south 80 degrees east 25 chains and 75 links to a stake and stones at the northwest corner of lands (nor or formerly) of Ernest Barton (now or former Bertha Barton); thence south 10 degrees west along the west line of said Barton to a stake and stones on the north line formerly of Herman Brink (now or formerly Bertha and Adna Barton); thence north 80 degrees west 25 chains 75 links to the point or place of beginning, containing 103 acres of land, subject to the rights of the public in and to the use of Harregrave Road running through said premises.
PARCEL No. 3:
ALL THAT TRACT OR PARCEL OF LAND, situate in the said Town, County and State bounded and described as follows: All that 13 acre tract bounded on the north by Piper Hill Road and lands (now or formerly) of H. Grant Reed and wife (formerly Bert Stannard); on the east by lands (now or formerly) of Bessie E. Vroman (formerly Martin Parsons); on the south by the Edson-South Windsor highway and on the west by lands (now or formerly) of Bartonville Grange No. 589, parcel 1 above described and Piper Hill Road.
EXCEPTING AND RESERVING from the above described Parcel No. 3 a certain lot situate on the northerly side of the Edson-South Windsor Highway 100 feet wide, front and rear, and 160 feet deep and lying and being 220 feet east of the said Grange lot, which lot is more particularly bounded and described in a deed from Charles W. Andrews to Norman Blewett and Elizabeth Blewett, husband and wife, as tenants by the entirety by deed dated February 17, 1955 and recorded in the Broome County Clerk's Office on February 23, 1955 in Book 888 of Deeds at page 83.
BEING the same premises conveyed to Norman R. Blewett and Elizabeth H. Blewett, husband and wife, as tenants by the entirety, by Charles W. Andrews as Parcel No. 3 of a deed dated August 30, 1952 and recorded in the Broome County Clerk's Office on September 2, 1952 in Book 809 of deeds at page 391.
Parcel Nos. l, 2 and 3 above being the same premises conveyed by Charles W. Andrews to Norman R. Blewett and Elizabeth H. Blewett, husband and wife, as tenants by the entirety, by warranty deed dated August 30, 1952 and recorded in the Broome County Clerk's Office on September 2, 1952 in Book 809 of Deeds at Page 391.
EXCEPTING AND RESERVING from said premises conveyed in Deed Book 809 at Page 391, the following parcels, to which deeds reference is hereby made for a more particular description:
1. A parcel conveyed by Norman R. Blewett and Elizabeth H. Blewett to Gary Norman Blewett by warranty deed dated June 1, 1968 and recorded in the Broome County Clerk's Office on November 22, 1968 in Book 1141of Deeds at Page 410.
2. A parcel conveyed by Norman R. Blewett and Elizabeth H. Blewett to Gary Norman Blewett and Bonnie M. Blewett, husband and wife, as tenants by the entirety, by warranty deed dated October 4, 1974 and recorded in the Broome County Clerk's Office on October 7, 1974 in Book 1219 of Deeds at Page 406.
3. A parcel conveyed by Norman R. Blewett and Elizabeth H. Blewett to Richard H. Baker, Jr., and Julie C. Baker, husband and wife, as tenants by the entirety, by warranty deed dated September 12 1975 and recorded in the Broome County Clerk' s Office on December 23, 1975 in Book 1234 of Deeds at Page 138.
4. A parcel conveyed by Norman R. Blewett and Elizabeth H. Blewett to Gary J. Walker and Gale Walker, husband and wife, as tenants by the entirety, by warranty deed dated February 16, 1990 and recorded in the Broome County Clerk's Office on February 20, 1990 in Book 1773 of Deeds at Page 634, and by correction deed between the same parties dated May 10,1994 and recorded in the Broome County Clerk's Office on June 7, 1994 in Book 1838 of Deeds at Page 985.
5. A parcel conveyed by Norman R. Blewett and Elizabeth H. Blewett to Gary J. Sheehan by warranty deed dated November 4, 2002 and recorded in the Broome County Clerk's Office on November 12, 2002 in Book 2015 of Deeds at Page 250, in which deed Norman R. Blewett and Elizabeth H. Blewett reserved a right of way thirty (30) feet in width located along the entire westerly line of the premises conveyed in said deed recorded in Book 2015 at Page 250 .
6. A parcel conveyed by Norman R. Blewett and Elizabeth H. Blewett to Kevin M. Blewett and Sandra L. Blewett, husband and wife, as tenants by the entirety, by warranty deed dated January 13, 2003 and recorded in the Broome County Clerk's Office on February 11, 2003 in Book 2023 of Deeds at page 421.
7. A parcel conveyed by Norman R. Blewett and Elizabeth H. Blewett to Nor-El Blew LLC by quitclaim deed dated November 30, 2012 and recorded in the Broome County Clerk's Office on December 4, 2012 in Book 2390 of Deeds at Page 429.
Norman R. Blewett died on August 30, 2008, a resident of the County of Broome and State of New York, leaving Elizabeth H. Blewett as his surviving spouse and the surviving tenant by the entirety.
The premises hereby conveyed are designated on the Broome County tax map for the Town of Windsor as tax map parcel 214.00-1-42.
