NOTICE
PLEASE TAKE NOTICE that upon the application of ENFRA MCC, LLC (f/k/a Bernhard MCC, LLC) (the "Applicant"), the Land Use Board of the Borough of Neptune City (the "Board") shall conduct an in-person public hearing on Tuesday, December 16, 2025, commencing at 7:00 P.M., at the Neptune City Borough Hall, 106 W. Sylvania Avenue, Neptune City, New Jersey 07753, to consider the Applicant's request for Use Variance Approval, Preliminary & Final Site Plan Approval, and Bulk Variance Approvals, all related to the development and use of proposed long-span rooftop and ground-mounted carport solar array facilities (collectively, "Solar Facilities") over the existing Hackensack IT Center and associated parking lots, for the generation of electric power supply for the IT Center. The Hackensack IT Center is located in the Highway Commercial (HC) Zoning District, on property with a street address at 2020 6th Avenue, more specifically known as Block 106, Lot 13 on the Official Tax Maps of the Borough of Neptune City (the "Property"). The Borough of Neptune City Zoning Ordinance does not specifically permit Solar Facilities; therefore, the Applicant is seeking Use Variance approval to permit the proposed use.
Preliminary and Final Site Plan Approval will also be requested for the Solar Facilities, which will consist of five (5) carport solar canopies and eleven (11) rooftop solar arrays on the roof of the existing building in addition to electric conduits, racking equipment and associated improvements.
The Applicant will also request Bulk Variance Approvals to allow: (i) a de minimis increase in impervious coverage from 71.71% to 71.86%, where a maximum impervious coverage of 70% is permitted; (ii) an accessory structure height of 18.6 feet for the carport solar canopies, where a maximum accessory structure height of 15 feet is permitted; and (iii) Solar Facilities to be located in the Front Yard, where accessory structures are not permitted in Front Yards in the HC Zoning District.
At the same time, the Applicant will also be requesting that the Board grant any and all other submission and/or design waivers, variances, Ordinance interpretations and/or other relief that may be deemed necessary to permit the development and use of the Property as proposed by the Applicant. During the course of the review of the Application and / or presentation of the Application, it is possible that bulk variances, submission waivers, design waivers, interpretations, and/or other exceptions from the requirements of the Borough of Neptune City Zoning Ordinance may be identified or deemed to be necessary to permit approval of the Application as submitted or with such changes as may be requested or accepted by the Board. This notice is to advise you that such additional approvals, variances, submission waivers, design waivers, interpretations, and/or other exceptions may be requested by the Applicant at the time of the Board hearing for this Application.
Anyone interested in this Application will have the opportunity to appear in person, by agent or attorney, at the meeting of the Land Use Board to be held on Tuesday, December 16, 2025, commencing at 7:00 P.M., at the Neptune City Borough Hall, 106 W. Sylvania Avenue, Neptune City, New Jersey 07753, to present any support for, or objection to, the approval of this Application.
ACTION WILL BE TAKEN AT THIS MEETING. THIS MEETING WILL BE HELD IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT pursuant to N.J.S.A. 10:4- 8(b).
The Board may at its discretion, adjourn, postpone, or continue the hearing from time to time, and you are hereby notified that you should make diligent inquiry of the Borough of Neptune City Land Use Board Secretary concerning such adjournments, postponements, or continuations.
