Notice of Public Hearing Before the Board of Adjustment, Nevada, Iowa
An appeal has been made with the Board of Adjustment of the City of Nevada, Iowa, by Lonnie Clark to allow an addition to be built west of the existing building at the property of 77 Lincon Highway., legally described as:
Lots Nine (9( and Ten (10), West Park Addition to Nevada, Iowa, and that portion of "M" Avenue, described as follows: Beginning at the NE corner of Lot 11, thence North 4 feet, thence East approximately 52.52 feet, thence South 4 feet, thence West to the point of beginning, all in West Park Addition, Nevada, Story County, Iowa subject to covenants, conditions, restrictions, and easements of record.
The building official was required, under the provisions of the Zoning Ordinance, to deny the building permit because the proposed construction did not comply in all respects with the terms of the Chapter 165 (Land Development-zoning regulations, specifically 165.09 (Zoning District regulations [Table 165.09-3: Interior Side Yard: 1-1.5 stories; Urban Corridor.]). A minimum of 10 (ten) feet is required setback from the side property line.
Pursuant to Section 121.1209, Code of Ordinances of Nevada, Iowa, 2003, the Board of Adjustment, after public hearing, may permit exceptions to the district regulations to authorize the proposed construction.
A public hearing will be held by the Board of Adjustment on the 12th Day of May, 2026, at 10:00 o'clock A.M., in the City Council Chambers in City Hall at 1209 6th Street, at which time you may submit your views on the matter in person, in writing, or by representative.
If you know of any interested property owner who, for any reason, has not received a copy of this Notice, it would be greatly appreciated if you would inform them of the time and place of the hearing.
