ORDINANCE 25-12-01 An Ordinance amending fees for use and availability of water and sewer services for residential and non-residential customers of the Otter Creek Lake Utility District. BE IT ORDAINED BY THE Otter Creek Lake Utility District, as follows: Section 1. Pursuant to the provisions of 70 ILCS 3705/0.01 et seq., the Board of Trustees of the District does hereby amend certain Sections of Ordinance No. 78-05-1 and certain Sections of Ordinance No. 78-05-05 and certain Sections of Ordinance No. 91-01-02 to provide for a schedule of fees to apply in the District effective January 1, 2026, for use and availability of water, and use and availability of sewer services for residential and non-residential customers of the District. Section 2 of Ordinance No. 78-05-1 is hereby amended to read: "Section 2. There shall be a fee of $28.39 per month imposed upon the owner of any residential lot within the District for the use of water supplied to such residential lot by the District. Such fee shall only be imposed with respect to such residential lots as are from time to time actually connected to the water distribution system of the District. For combined lots, such fee for each additional lot so combined shall be $7.11." Section 3 of Ordinance No. 78-05-01 is hereby amended to read: "Section 3. There shall be a fee of $11.36 per month imposed upon the owner of any residential lot within the District for availability of or readiness to provide such lot with water service by the District. Such fee shall only be imposed with respect to such residential lots as are from time to time not actually connected to the water distribution system of the District." Section 4 of Ordinance No. 78-05-1 is hereby amended to read: "Section 4. There shall be a fee of $38.38 per month imposed upon the owner of any residential lot within the District for the use of the sewerage collection and treatment system of the District. Such fee shall only be imposed with respect to such residential lots as are from time to time actually connected to the sewerage system of the District. In addition thereto, there shall be imposed per month upon the owner of any residential lot within the District for debt service, to pay part of the cost of principal and interest of bonds issued for improvements to the system, the sum of $2.39, for a total sewer user fee of $40.77. For combined lots, such fees for each additional lot so combined shall be $9.05." Section 7.3(E) of Ordinance No. 91-01-02 is hereby amended to read: Availability Charge: To cover the proportionate share of the cost of making sewage collection and treatment available to each residential lot not connected to the sewer system, each such lot owner shall pay a flat rate of $16.31 per month. Section 7.3(D) of Ordinance No. 91-01-02 is hereby amended to read: "Non-metered Users": All non-metered users of the waste water facility shall pay a minimum flat rate charge per month, billed quarterly, which shall be adequate to cover the cost of operation, maintenance, and replacement of the system as determined by the basic user charge and the charge for debt services on bonds issued for system improvements. Basic User Charge $38.38 Debt Service Charge $ 2.39 Total Flat Rate $40.77 Section 2. This Ordinance shall be in full force and effect on and after January 1, 2026, and shall be published prior to such date as required by law.
