ORDINANCE NO. 2038-1125 AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, ABANDONING A PORTION OF RIGHT OF WAY RUNNING ALONG 127TH AVENUE GENERALLY LOCATED SOUTH OF ELWOOD STREET, IN AVONDALE, ARIZONA. WHEREAS, Article I, Section 3 of the Avondale City Charter authorizes the City of Avondale (the "City") to dispose of its acquired property as the City's interests may require; and WHEREAS, the 127th Avenue Right-of-Way recorded at Instrument No. 19900394935 in the Maricopa County Recorder's Office on August 31, 1990 (the "ROW"), was conveyed to the City when the City annexed Lakin Ranch through Ordinance Number 1652-518 adopted by the Council of the City of Avondale (the "City Council") on May 21, 2018; and WHEREAS, the City Council has determined a portion of the ROW, approximately + 0.5531 acres, is no longer necessary for public use (the "Abandoned ROW") and the City is authorized to vacate and abandon rights-of-way pursuant to Ariz. Rev. Stat. § 9-240(B)(3)(e) and Ariz. Rev. Stat. § 28-7205; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVONDALE as follows: SECTION 1. The recitals above are hereby incorporated as if fully set forth herein. SECTION 2. The Abandoned ROW, as more particularly described and depicted in Exhibit A, attached hereto and incorporated herein by reference, is hereby declared to be no longer necessary and is hereby abandoned to the adjacent property. SECTION 3. The Mayor, the City Manager or authorized designee, the City Clerk and the City Attorney are hereby authorized and directed to take all steps and execute all documents necessary to carry out the purpose and intent of this Ordinance.
