ORDINANCE NO. 2045-1225 AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, ACCEPTING THE DONATION OF TWO PERPETUAL EASEMENTS FROM TOLLESON UNION HIGH SCHOOL DISTRICT, PROVIDING FOR NOISE, ODOR AND AESTHETIC SETBACKS ON REAL PROPERTY LOCATED GENERALLY SOUTH OF ALAMAR BOULEVARD AND EAST OF SOUTH DYSART ROAD. WHEREAS, Article I, Section 3 of the Avondale City Charter authorizes the City of Avondale (the "City") to acquire real property in fee simple or any lesser interest, inside or outside its corporate limits for any City purpose, when the public convenience requires it and in accordance with the provisions of State law; and WHEREAS, the City Council desires to accept, from Tolleson Union High School District (the "Owner"), the donation of real property for public use, generally located south of Alamar Boulevard and east of South Dysart Road in Avondale, Arizona. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVONDALE as follows: SECTION 1. The recitals above are hereby incorporated as if fully set forth herein. SECTION 2. The donation of two perpetual easements providing for noise, odor and aesthetic setbacks, by written agreement of the Owner and the City attached hereto as Exhibit A, for parcel APN 500-72-001C, over and across ± 5.75 acres of real property and for parcel APN 500-72-001P, over and across ± 4.66 acres of real property, both incorporated herein by reference and generally located south of Alamar Boulevard and east of South Dysart Road in Avondale, Arizona, as more particularly described and depicted on Exhibit 2 of Exhibit A attached hereto and incorporated herein by reference, are hereby accepted by the City from Tolleson Union High School District for public use. SECTION 3. The Mayor, the City Manager, the City Clerk and the City Attorney are hereby authorized and directed to take all steps and to execute all documents necessary to carry out the purpose and intent of this Ordinance.
