ZONING BOARD OF ADJUSTMENT
PUBLIC NOTICE
PLEASE TAKE NOTICE THAT on the 23rd of October, 2025, at 7:30 pm at the Rumson Municipal Building, 80 East River Road, Rumson, New Jersey, the Zoning Board of Adjustment of the Borough of Rumson will hold a public hearing on the application of Jill Fallon, at which time all interested persons will be given an opportunity to be heard.
The location of the premises in question is in the R-5 Zone as shown on the Borough Tax Map, Block 66, Lot 2 and commonly known as 73 Ave. of Two Rivers, Rumson, New Jersey.
The Applicant is seeking approval for the following: 2nd floor addition, covered front porch addition, rear deck and outdoor improvements to an existing single family residence.
The Applicant is applying for the following variances:
Borough of Rumson Ordinances / Development Regulations: Schedule 5-1 (Zoning District Regulations), Section 7.3 (Nonconforming Lots, Uses, Buildings and Structures), Section 7.8 (Accessory Buildings and Structures).
The enlargement, extension or addition to a nonconforming building must conform to all requirements and not result in the creation of any new nonconformity related to the lot and the aggregate of all structures or building: The proposed additions will intensify existing nonconformities and create new nonconformities.If any nonconforming structure shall be more than partially destroyed, then the structure may not be rebuilt, restored or repaired, except in conformity with this chapter: The extent of the proposed additions will cause the existing nonconforming building to be more than partially destroyed.3. Minimum Front Yard Setback: 35 feet required, 28.3 feet existing, 28.3 feet proposed (non-conformity is intensified with the proposed 2nd floor addition).4. Minimum Front Yard Setback (Front Porch): 30 feet required, 25.4 feet existing, 21.3 feet proposed.5. Minimum Side Yard Setback: 7 feet required, 4.7 feet existing, 4.7 feet proposed (non-conformity is intensified with the proposed 2nd floor addition).6. Minimum Side Yard Setback for Rear Deck and Steps: 7 feet required, 9.3 feet existing, 6 feet proposed.
There are existing nonconformities that are unchanged by the proposed work:
1. Accessory Building Side Yard Setback: 5 feet required, 2.8 feet existing.2. Accessory Building Rear Yard Setback: 5 feet required, 4.4 feet existing.
All persons interested in this application will be given ample opportunity to be heard at the above. A copy of the application and supporting documents are on file at the Rumson Municipal Building, 80 East River Road, Rumson, New Jersey and can be examined on the Borough website (www.rumsonnj.gov) under the "Government" tab, then selecting "Zoning Board".
