Notice to Defendant
Nature of this action. This is an action to Quiet Title, based on a possible defect in prior owner's title to a parcel of real property acquired by plaintiffs. The subject Property is located adjacent to Sherwood Road, in the Town of Cortlandt, Westchester County and is described as set forth in Schedule A below. Defendant Lake Peekskill Realty Corporation, Inc. acquired title to the Property in 1933 but is believed to have been dissolved prior to 1960. No deed has been found by which defendant ever conveyed the Property. Search of Plaintiffs' chain of title indicates there was no deed of record into the prior owner. The prior owner owned the property for over 46 years and is alleged to have acquired title by adverse possession, if in fact there was no deed into him.
Relief Sought: Plaintiff seeks a judgment adjudging the estate and interest of the plaintiffs in the subject property to be free and clear of any claim or potential claim of the defendant and that defendant and every person claiming under them be barred from all claim to assert an estate or interest in the Property. Plaintiffs do not seek money damages.

All that certain plot, piece or parcel of land, situate, lying and being in the Town of Cortlandt, County of Westchester and State of New York, being bounded and described as follows: BEGINNING at a point in the easterly boundary line of the lands now or formerly of Clearwater Country Homes, Inc., said point also being the northwesterly corner of Lot No. 13 as shown on the map of Peekskill Terrace filed in the Office of the Westchester County Clerk, Division of Land Records as Map No. 1793; THENCE along the aforementioned boundary line now or formerly of Clearwater Country Homes, Inc. North 6 degrees 22 minutes 20 seconds West 361.72 feet to a point; THENCE North 6 degrees 33 minutes 00 seconds West along the northerly boundary now or formerly of Clearwater Country Homes, Inc. to the northerly line of the Peekskill Hollow Creek; THENCE southeasterly about 32 feet to a point on the southerly shore of said creek, said point also being the northwesterly corner of lands now or formerly of Marie Havel; THENCE South 23 degrees 36 minutes 00 seconds East along the westerly line of lands now or formerly of Havel, 175.14 feet to a point, said point also being the southwesterly corner of lands now or formerly of Marie Havel and the northwesterly corner of lands now or formerly of Victor and Elvira Rolanti;
THENCE along the westerly line of lands now or formerly of Rolanti, South 23 degrees 36 minutes 00 seconds East 233.68 feet to a point, said point also being the southwesterly corner of lands now or formerly of Rolanti and being in the northerly boundary line of Lot No. 14 as shown on map of Peekskill Terrace aforesaid; THENCE along the said northerly boundary line of said Lot No. 14, about 46 feet to the northeasterly corner of the aforementioned Lot No. 13;
THENCE along the northerly boundary line of Lot No. 13 about 85 feet to the point or place of BEGINNING.
