SPECIAL COMMISSIONER'S NOTICE OF SALE
WHEREAS, on December 18, 2009, Oscar T. Hundley, a married man, and Keyana Hundley, signing pro-forma to perfect lien only, executed a certain deed of trust to ReconTrust Company, N.A., Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. as nominee for Bank of America, N.A., which deed of trust is of record in the Office of the Chancery Clerk of the First Judicial District of Hinds County, State of Mississippi in Book 7101 at Page 7639, and Modified in Book 7149 at Page 3500, thereafter pursuant to 28 USC § 2410 (c) judicial foreclosure was filed on December 19, 2024; and
WHEREAS, said deed of trust was subsequently transferred and assigned to Wilmington Savings Fund Society, FSB, as Trustee of Stanwich Mortgage Loan Trust F by instrument dated September 19, 2022 and recorded in Book 7285 at Page 8296 of the aforesaid Chancery Clerk's office; and
WHEREAS, Wilmington Savings Fund Society, FSB, as Trustee of Stanwich Mortgage Loan Trust F, has heretofore substituted McPhail Sanchez, LLC as Trustee by instrument dated May 9, 2024 and recorded in the aforesaid Chancery Clerk's Office in Book 7307 at Page 5961; and
WHEREAS, said deed of trust was subsequently transferred and assigned to Wilmington Savings Fund Society, FSB, as trustee of Discovery Mortgage Loan Trust by instrument dated August 1, 2024 and recorded in Book 7309 at Page 9190 of the aforesaid Chancery Clerk's office; and
WHEREAS, Kent D. McPhail, or his agent was appointed Special Commissioner by Order of the Chancery Court dated August 14, 2025 in Hinds Co. Chancery Cause No. G2024-1505 M/4 and was authorized to sell the subject property under direction of the Court; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, Wilmington Savings Fund Society, FSB, as trustee of Discovery Mortgage Loan Trust, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, Kent D. McPhail, Special Commissioner, will through my agent, a duly appointed auctioneer, offer for sale at public outcry on October 15, 2025 and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the North Front Door of the Hinds County Courthouse located at 407 East Pascagoula Street, Jackson, MS 39201 to the highest and best bidder for cash the following described property situated in the First Judicial District of Hinds County, Mississippi, to-wit:
Lot 1, Garden Park Terrace, Part 4, a subdivision according to a map or plat thereof which is on file and of record in the Office of the Chancery Clerk of Hinds County at Jackson, Mississippi, in Plat Book 21 at Page 17, reference to which map or plat is hereby made in aid of and as a part of this description.
I WILL CONVEY only such title as vested in me as Special Commissioner.
