SUBSTITUTE TRUSTEE'S NOTICE OF SALE
WHEREAS, on June 6, 2022, Melanie Nicole Smith, a single woman, executed a Deed of Trust to Granville Tate, Jr., Trustee for the benefit of Mortgage Electronic Registration Systems, Inc, as recorded in the office of the Chancery Clerk for the First Judicial District of Hinds County, Mississippi, in Book 7282 at Page 5297; and,
WHEREAS, Mortgage Electronic Registration Systems, Inc, assigned said Deed of Trust to Trustmark National Bank by instrument dated October 25, 2024, and recorded in Book 7315 at Page 3562 of the records of the office of the Chancery Clerk for the First Judicial District of Hinds County, Mississippi; and,
WHEREAS, Trustmark National Bank, the holder of said Deed of Trust and the Note secured thereby, substituted McKay Franklin PLLC as Trustee in said Deed of Trust, as authorized by the terms thereof, by instrument dated December 9, 2024, and recorded in Book 7315 at Page 9828 in the office of the aforesaid Chancery Clerk; and,
WHEREAS, on or about August 1, 2025, Trustmark National Bank, a national banking association, converted to Trustmark Bank, a Mississippi banking corporation ("Trustmark Bank"), retaining all rights, claims, and interests in and to the aforementioned Deed of Trust and the indebtedness secured thereby; and,
WHEREAS, default having been made in the terms and conditions of said Deed of Trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness having requested the undersigned Substitute Trustee to execute the Trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee's fees and expenses of sale;
NOW, THEREFORE, the undersigned McKay Franklin PLLC, being the Substitute Trustee, does hereby give notice that on December 30, 2025, between 11:00 o'clock a.m. and 4:00 o'clock p.m., being the legal hours of sale, it will proceed to sell at public outcry, to the highest bidder for cash, at the north front door of the Hinds County Courthouse in Jackson, State of Mississippi, the following real property described and conveyed in said Deed of Trust, lying and being situated in the First Judicial District of Hinds County, Mississippi, and being more particularly described as follows, to-wit:
Lot 21, Lake Trace North, Part 3, a subdivision according to a map or plat thereof which is on file and of record in the office of the Chancery Clerk of Hinds County, at Jackson, Mississippi, in Plat Book 22 at Page 30, reference to which map or plat is hereby made in aid of and as a part of this description.
The undersigned will convey only such title as is vested in it as Substitute Trustee.
