SUBSTITUTED TRUSTEE'S NOTICE OF SALE
STATE OF MISSISSIPPI
COUNTY OF HINDS 1ST
WHEREAS, on the 24th day of July, 2002, Shemela O. Johnson, aka Shemela Johnson, a single person, executed and delivered a certain Deed of Trust unto Wyman Jones, Trustee for Community Bank of Mississippi, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Hinds 1st County, Mississippi in Book 5608 at Page 344 Instrument# 767826; and
WHEREAS, on the 19th day of November, 2024, the Holder of said Deed of Trust filed a Loan Modification Agreement of Deed of Trust by instrument recorded in the office of the aforesaid Chancery Clerk of Court in Book 7315 at Page 4713 Instrument# 1896805; and
WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to PennyMac Loan Services, LLC by instrument recorded in the office of the aforesaid Chancery Clerk in Book 7221 at Page 2147 Instrument# 1625083; and
WHEREAS, on the 10th day of October, 2017 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Book 7210 at Page 9162 Instrument# 1605942; and
WHEREAS the Order Granting Motion for Default Judgment and Final Judgment on the Pleadings has been rendered in the matter Bank of America, N.A. vs. Shamela Johnson et al.; Cause No 18-cv-00072 of the First Judicial District Chancery Court of Hinds County, Mississippi, rendered on the 29th day of May. 2018. Order Granting Motion for Default Judgment and Final Judgment on the Pleadings recognizes Shemela O. Johnson as the lawful holder of subject property, imposes an equitable lien against the interests of Shemela O. Johnson, and grants a declaratory judgment stating the imposition of said equitable line with a good, valid, and enforceable first lien of the Deed of Trust in Book 5608 at Page 344, Instrument 767826. Said Order Granting Motion for Default Judgment and Final Judgment on the Pleadings appearing in the Hinds County, First Judicial District Chancery Clerk's land records in Book 7220 Page 2422, Instrument Number 1624924 on June 7, 2018; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 21st day of November, 2025, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the main North front door of the Hinds 1st County Circuit Courthouse at 407 East Pascagoula Street at Jackson, Mississippi, for cash to the highest bidder, the following described land and property situated in Hinds 1st County, Mississippi, to-wit:
A parcel of land situated in Lot 19 of Schroeder's Third Subdivision according to the Plat on file in the office of the Chancery Clerk at Jackson, Hinds County, Mississippi as now recorded in Plat Book 4 at Page 43, and being more particularly described as follows:
From the intersection of the East right of way of Grant Street with the North right of way of Brown Street, said point being 20 feet Northerly from the South line of Lot 19 of Schroeder's Third Subdivision; thence Northerly along the East right of way of Grant Street for a distance of 222.0 feet to the true POINT OF BEGINNING of the property herein described; continue Northerly along the East right of way for a distance of 80.0 feet; thence right through an angle of 90 degrees and run Easterly for a distance of 135.3 feet to a point; thence right through an angel of 90 degrees and run Southerly for a distance of 80.0 feet to a point; thence right through an angle of 90 degrees and run Westerly for a distance of 135.3 feet to the POINT OF BEGINNING.
AND,
A parcel of land situated in Lot 19 of Schroeder's Third Subdivision according to the Plat on file in the office of the Chancery Clerk at Jackson, Hinds County, Mississippi as now recorded in Plat Book 4 at Page 43, and being more particularly described as follows:
From the intersection of the East right of way of Grant Street with the North right of way of Brown Street, said point being 20 feet Northerly from the South line of Lot 19 of Schroeder's Third Subdivision; thence Northerly along the East right of way of Grant Street for a distance of 142.0 feet to the true POINT OF BEGINNING of the property herein described; continue Northerly along the East right of way of Grant Street for a distance of 80.0 feet; thence right through an angle of 90 degrees and run Easterly for a distance of 135.3 feet; thence right through an angle of 90 degrees and run Southerly for a distance of 80 feet; thence right through an angle of 90 degrees and run Westerly for a distance of 135.3 feet to the POINT OF BEGINNING.
I will only convey such title as is vested in me as Substitute Trustee.
